Default what does this mean

I was scheduled for my ssi hearing on 8/3/2010 at 3 pm my lawyers sec. called me at 9 am and said my lawyer called and said i didnt have to go to my hearing the alj already made a decision on my case and I would get a letter in about 3 weeks its been 15 days now no letter does it mean I got approved?

Had you been denied before now and the hearing was for an appeal?

I don't know if even your atty would know?? .. maybe all they do is let them know that a decision has been made - so that you both don't show up for the hearing..when there isn't going to be one.

I don't know if it is like work comp - on my state's website - after a time the WC decisions are posted on the state website... but those might be after all parties have been notified.

Sometimes it is just hard to know ....
but I suppose it has to go thru all the right channels before you get notified..
And I'm sure there is a backlog in the whole system now so that slows it all down too.

yes you were approved. you would have had to have had a hearing in order to be denied at the alj level.

I had been denied 2 times then had my hearing before the ALJ that is the one where my lawyer called and said I didn't have to go to the hearing that the judge already made a decision without me being there.

Well I hope you were approved, if not it sounds to me like your rights were violated. The hearing in front of an ALJ is very important and if you don't win that means you have to arrange to be heard by the Appeals Council which can take anywhere from 7 to 30 months. The ALJ hearing is the one that proves you are disabled and you can go over all your medical records with the judge make sure the judge understands all your injuries, what medications your on and that you cannot do any substantial gainful activity or residual functional captivity. I don't know why your attorney would say not to go, unless he was told you are approved. Well good luck.

I found out from the lawyer today that the judge told him that there was no need for him to see me that I should never had been turned down in the first place. and he mad a decision in my favor and said that he found me 100% disabled

That's good glad that's over with. I hope you get a catastrophic rating that way you have very little or no co-pay.

basically,yes!!
He obviously made a on the record decision,which he based his decision on the meritts of the case file,he thought there was enough strong findings,instead of having a hearing,thats how i was approved for ssi and ssdi,after 4 years and 3 turn downs lol

you dont neccesarily have to have a hearing to be denied really.
A judge can decide to denie based on any reason,you know that lol

good for you,same as i.dont forget,if you have a financial emergency in the mean time,you can go ask for a emergency advance,for in fear being tossed out,or utilities shut off,ect,because the money wont come fast...well,the ssi is processd at the local office,took them about a week after my approval to get ssi check and the backpay,but am still waiting on the ssdi..but just have patient,
