We are moving away from the Boise / Meridian, Idaho area. We have owned a mountain cabin 15 miles northwest of McCall for 9 years. It has been an ongoing project needing lots of work. I've been doing some of the building myself. Trying to build and improve while still maintaining acres of land that needs to be wildfire safe is a lot of work. Then, in winter, the snow that slides off the roof can pile up 10 feet deep. I'm going to need another cord of firewood to make it through the winter. I have the logs. I just need to cut and split them.

For now, we need to get the 26 foot truck packed. I had to hire a loading crew because I can not load the truck. My neighbor took out a court order preventing me from being witin 300 yards of his house which is next door to my house. So, I can't even be at my own house. I stepped on his property to work on repairing my fence and he had me arrested for trespassing. With the trespassing arrest came a court order to stay away from my own house. I have a legally recorded easement to step on his property to repair and maintain my fence and landscaping but he convinced the police that the easement did not mean I could not be arrested for trespassing. This neighbor is a big part of why we are moving. It is problematic to be living next to a paranoid-schizophrenic man who is also a law enforcement officer. The court system is very slow and biased against defendants.

The stress in our lives since May 23rd, 2013 has been ridiculous. The financial cost is enormous but the emotion stress cost is worse.

Part of my neighbor's issue is he considers my brain injury to be a mental illness. When he confronts me, I tend to get loud and may yell at him. He thinks it makes me a dangerous criminal. His paranoia takes a simple act like working on a fence and turns it into a criminal matter. We will be free of his influence soon. I just need to get the court or a jury to recognize that my easement means I did not trespass. That trial comes November 13, 2013. My attorney can't believe the prosecutor thinks this is a valid criminal charge.

Sorry for airing my dirty laundry. I am emotionally and physically exhausted. My wife is not any better. We are too old to be fighting with a cranky neighbor cop who can get a judge to make ridiculous rulings. So much for innocent until proven guilty.

So, now people should understand why we are taking the extreme step and moving.

btw, It is not uncommon for people to take such actions against the brain injured. Unfortunately, there is a serious lack of advocacy for us when dealing with troublemakers.
