Just last week I found out the amount of compensation I was due from the insurance company under state law in RI because of my injury. I saw a surgeon (the one who did my 2 surgeries, somewhere along the line during which I developed RSD), who deemed my loss of use to my upper extremity to be 7% (3% is due to pain). In dollars that equals a whopping $1,965!
I am unable to do anything strenuous with my arms because 12 hours later I will wake up in excrutiating head pain which will last for hours or even days (i.e. - I vomit if I try to move - forget even trying to get to an ER - impossible). And all that's worth is just under $2K? What an unbelievable bummer!!
My lawyer advised me not to fight it. I am anxiously waiting for a decision on ketamine treatments from the same insurance company. So of course I signed the stupid agreement...my lawyer is deemed to be pretty good and so far has proved himself to be trustworthy. Since we likely have quite a battle in front of us in the courts for ketamine treatments he may think it's not worthwhile to fight over loss of use %'s for an office worker.
Good luck with Delaware laws, and with your IME. Workers Compensation in RI is a broken system. Hopefully Delaware is better....
