My in-law's got my husband to make out another will 3 days before he died so mine is no good unless I can contest it because my husband's signature doesn't look like his. At least I'll get the life insurance money which could be more and the lawyer will find that out tomorrow.

What did he die from?? -- the cause on the death certificate?? It sounds to me like there could be a real strong case made for manipulation -- 3 days before death he had to be really-really sick

Also, if he didn't also change the insurance policy, maybe a case could be made that changing the will was not his intent.

Crap, I wish the "life experiences" would leave you alone so you can get a chance to catch your breath

My EX created a very complicated "family trust" that disowned his kids and left the house to his wife to use as long as she was alive, then it was to go to his oldest boy. She bided her time -- a year and a half or so and then sold the place out from under everybody. Totally illegal. But, no one wanted to do anything but me and I have no rights or interests. Real expensive lesson for his kids to learn

I hope you find a way to straighten this out without having to get a law degree (or an ulcer).

Hmm , did he die at their home or in a hospital?
The lawyer could look into possible manipulation or influence by the family -esp if he was drugged or in extreme pain. {Dr or hospital records?}
But you don't want to rack up a big atty bill and then find out that you don't have a case/claim.

but we had to have BIL do a basic quick will 3 days before he died because until then we thought he had one at the fathers house.

We should have done a trust but things went downhill so fast and we thought things were covered.

My husband died at his mom's house 70 miles away from his home. That makes it look suspicious alright, doesn't it? I asked my attorney to compare the signatures.

Dear befuddled2,

If you were still married at the time of his death, and if you spoke to an attorney, then you know that spouse's have guaranteed rights of inheritance that vary from state to state. If his insurance policy lists you as a beneficiary, that is NOT part of his estate. You are entitled to at least one-third of his estate, regardless of what his final will states.
