HI,
Well - here is what he got: He pleaded GUILTY to DV Assault.

$2,500 fee SUSPENDED
92 days in JAIL SUSPENDED
MUST COMPLETE 36 SESSIONS OF DV INTERVENTION CLASSES
ON 18 MONTHS MONIVATED CITY COURT PROBATION
6 MONTHS UNSUPERVISORED PROBATION
MUST PAY COURT FEE
ANOTHER NO CONTACT ORDER FOR HIM.
NO ALCOHOL

So, NO trial. This is because of the prior's, he did what he was supposed to
do which was what they called back East batterer's program and completed it, and probation.

So, he got the same damn thing as he did back East.

Then he had the nerve to make a list of things he wanted. AFTER I had already packed up his things TWICE and he picked them up outside. He can take me to CIVIL court and SUE me for them. Which is a joke, he has them.
I told the prosecutor that, and that was when HIS order was in effect so he broke it by coming here. He told his Public Defender.

I was TOLD to get a DIVORCE, MOVE if I could. OHHHHHHHHHHHHHHH
I am really upset.

There is NO HOPE for women that are victims of domestic violence, unless they are killed.

Oh, then he said he would pay for the computer he smashed, so I wouldn't have to.

I said that wasn't my computer, it belongs to the school he goes to.
So, he got caught in another LIE.

Sorry that you didn't get what you want.

If he messes up, he goes to jail, right?
And he cannot contact you.

Maybe it is good that there is no trial and that this one big stage is over for you. A trial sounds like more stress.

Yes, if he mess's up he goes to jail the judge told him that was a promise!!!!

If he hadn't pleaded guilty and we went to trial, well he didn't want that.

He deserves a lot more than he got.

Because they don't change, it will happen again sooner or later.

I am very upset of the outcome.

I woke up with a migraine, took 2 Excedrin Migraine pills and it went away.

Today I am not even getting dressed, I am going to relax and sleep. I am drained.

I agree that this might be good and diffuse a powder keg...i know it isn't what you wanted but it really might be for the best....
i hope you can unwind now and just let go even for just a little while

Nikko,
I am sorry that things did not go as you thought, but it is a win!

First, the court systems avoid the trials as much as possible, it is the backlog, the system, and everyone wants to get a win without spending a day or two or longer in court.

But, think about this, if he had jail time, if he went in for the 90 days, how pi$$ed would he be when he got out. I dearly would have worried for your safety. With this order, he cannot sneeze anywhere around you, literially!

Getting him to the classes he never took is a win. Our agency has the batters group, really eye opening. They do not take crap, don't cut them slack. They have to take ownership, particpate, and complete the program. IF not it is a violation of the order and the get out of jail free card is done!

You really do not know if you are going to win a case in a trial, a plea with strong monitoring is a big win. HE can't come near you if he sees you in the same store, he will have to leave, not you.

In my case, my car was pinned between my garage and my abuser: my brother violating the order for the dozenth time. The police told me to get thicker skin, as he continues to follow, tried to run me off the road as I left my driveway, countless phone traces and threats aginst my life "get thicker skin!" was their advice!

I could not get a magistrait to issue a in contemp, they said he was only in the area! The cop and him, while smart Joe gleamed and that crappy grin was on his face. I pursued. What right do they have to be judge and jury for him? That is not how the system is to work, they make the criminal arrest and he goes to court, not they tell me they beleive him!!! (Oh, the Sgt.'s neice hit my car and there is ligiation against her for my injuries)

Brother went to court trial and said he was in the area but never spoke to me, he was in an ajoining property belonging to another brother.
He did not even go near there! He drove up my drive as I was getting in my car and pinned ME in.

The woman judge, actually reamed me out for wasting the court time, she believed him, apologised to him for the injustice to him on behalf of the court!

His witness said she was there behind him, my son said he heard a vehicle come up my drive, knew I was leaving and went to the front door where he saw me trying to get in and the brother leaving from near my car.

My brother said there were three toddlers on the highway out front playing on tricycles? His gf did not see any kids in the area, she did not see me in the area....But brother testifird he saw me ignored me and left. Gf said he took the car back and they left immediatly....
They contridicted each other, and still she believed him! There are no small children any where around us, and what parent would let kids play on a highway that leads to an Interstate entrance and exit.

If I as a law enforcement officer could not be protected by the police, the courts, the system, how are women in general treated?

But, you really did win, the biggest win, is it is over.

And Nikko, if it took the court letting my abuser win to quit the overwhelming terrorizing of my young daughter, to have him stop following me, to stop the harassing and threats, then so be it. There have only been a few incidents this year by phone. I have an outside video system, I carry my protection, a cellphone with a camera and my own protection.
I am in control now, let him dare to come near me and threaten or assult me now.

I just feel he is laying low though. He will give it enough time and one day during hunting season, as I am near my home which is wooded, he will get me. The sad part is my family feels the poilice will never treat it as more then an accidental shooting!

Gal, hold your head up, you really won, a win for all of us that have the court against our abusers. You did an excellant job, you have the power now and he has to knnow what an awsome power over him it is.

After all this time and two trips to your home to get his stuff they will say anything left behind was abadoned. Also, you can end up charging storage if he knew to get it out and didn't by coming the first time and leaving it.

Feel better Nikko, I know the stress the head pain like a 2 X 4 hit it from the ordeal. It is not continued, it is nt that his attorney cancelled the last minute, It Is really over and he had to say the words he is guilty of domestic abuse!

Way to go to stick to it gal, I am so proud of the strength you found to keep up with their games and be a winner.

My husband and I had a woman judge and she too sides with my abusive husband. I think that a man judge would be better to be honest.

If he does complete the 2 yrs probation and 36 classes he has to pay for, I do believe it will then be dismissed as they were back East.

It's like well they paid for their mistakes, makes me sick.

I am sure it still stays as a record, but oh I don't know.

I just reviewed all of his things. He won't be done until May of 2008.
