Default MMI Question

I just had a L5/S1 microdesectomy/laminectomy 2 weeks ago due to an on the job injury. I am currently drawing comp. My question is what is the average time after this type of surg before they declare the pt has reached MMI. I was told by an attorney it is usually around 1 year, does this sound right to you guys? I'm in Ky.
