On the record decision

I was scheduled for my hearing before the administrative law judge for this friday Feb 3.

I received a call today from my attorney's office telling me that I DO NOT have to go to the hearing on Friday as the judge made an "On the Record Decision".

I asked what that meant and I was told I would have to wait to receive paperwork in the mail. However, she also told me that she never heard of it being a bad thing, but could not tell me I was approved, just that I have to wait!!

Does anyone know if an On the record decision is ALWAYS favorable??

Do a google search. As far as I know-OTR means that they have obtained enough information too declare you disabled.

I have been looking it up, and yes everything I read makes it sound like a favorable decision.
I will just be glad when I get a letter telling me FAVORABLE!!

it cannot be unfavorable or else you are entitled to a hearing.

Babyboomer15 02-09-2012 07:29 AM

Have you been checking your bank account because your backpay may have already been deposited?

daisy.girl 02-11-2012 12:37 AM

everyday.....nothing yet!!

Sonny1 02-11-2012 02:23 PM

My whole process was done through the mail and my decision was a "Fully Favorable On the Record "one. That is specifically what that is made for, so you don't have to go to court and they can make a favorable decision with the info. they have, so as not to have to go through the whole long process!

So a congrats is in order!!:)

I called SS yesterday, and they said they have no decision in my record as of now. They told me the ALJ will have to write his decision and turn it in, before it is recorded!
I hope this doesn't mean something is wrong?

Sonny1 02-12-2012 01:20 PM

No, don't worry! The SSA department is always lagging behind. They sometimes get the information after you do! That is why people say watch your bank acc't, you may see the $$$ b4 the letter in the mail!

daisy.girl 02-12-2012 10:34 PM

I sure hope you all are right. I would have just felt so much better if the SSA, had told me the decision was favorable. I can wait....just knowing that it is coming soon!!

Until you have a decision in writing, your claim is still pending. What your lawyer said to you could be correct, but SSA can't act on what your lawyer said that the ALJ said. It all has to be in writing.

Got the decision letter today.

FULLY FAVORABLE!!
I am so glad, now I guess I have to wait on the reward letter to see how much I will get each month, how much back pay, and how much the lawyer takes.

thanks to all who replied to me :)

Teatime 02-24-2012 07:31 PM

Congratulations! You'll likely get your money in no time. Did the letter say what they found your date of disability to be? You don't get paid for the first four months after that so if you know the disability date they determined, you can figure out the back pay.

daisy.girl 02-29-2012 09:13 PM

Can anyone tell me if I have to pay taxes on my back pay that I receive? and is my disability monies, considered as income? My husband and I file jointly....will I have to pay taxes on my disability money?

gilbert 02-29-2012 09:26 PM

congrats

From what I've heard from friends, yes, you will have to pay taxes on the lump sum back pay if it's substantial. I can't tell you whether you will have to pay taxes on your disability money because that depends on you and your husband's income. Speak with a tax preparer or lawyer.

echoes long ago 03-01-2012 01:04 AM

you can usually reduce the taxes you owe by spreading out the back pay for the years that it is for. in other words you can file so that all of the backpay isnt for 2012, it can be applied to 2011, 2010 etc for whatever years it covers.

When I received my back pay and it was a decent amount, they didn't take any taxes out.

Once I got my letter it was about 3 weeks before it was in my acct.

Once you see the deposit, it will be a 1000lbs off of your shoulders.

Good luck and Keep your head high :grouphug:
