Alj hearing opinions please!!

--------------------------------------------------------------------------------

Hi all, new here and looking for insight or thoughts on my hearing.
Thanks in advance.

Attorney talks to judge first then came asked me if I would change onset date to Feb 2011 (yeah)

We go back and judge introduces himself and Ve Dr something (I can't remember) he was very nice.
Asked if I agreed with new onset date, I said yes.
Asked about my day and pain levels and how it affects my day to day living, listed all my diagnoses and asks Ve if there any jobs I can do, Ve said no, then asks about how meds affect me and asks Ve again if there are jobs while I'm taking these meds, Ve says no, judge asked Ve if I could work 2 hours a day Ve said no.
Then he asked my attorney if there was anything she wanted to add and she brought up my gaf score, last year was 50 and 1 year later it was 47.
Also asked about my schooling, how far I went if I ever failed.

He seemed very sympathetic to my shoulder pain, and he said when he first looked at my records he thought of his wife who had breast cancer and how her arm and shoulder hurt her from the surgery, then he just got quite for a minute. I thought it was kind of him to share that because it helped put me at ease (like he understood what I was going through).

Then he told me we were done but asked attorney to stay, when she came out she told me it looked like a fully favorable but not to call the office and mention it or she would deny it lol.
It all lasted about 40 min and I was not as nervous as I thought I would be, got lucky and got a very pleasent judge and Ve.
Attorney also said I would hear something in 30to 60 days So I guess the second phase begins.
So glad this part is over.

So does this sound good?
No jobs I can do due to diagnoses and meds,
changing onset date,
not being able to work 2 hours a day,
Ve said there was nothing I could do.
Thanks
Bambi

Sounds good but don't believe it until you see it in writing which will be soon. Don't be surprised if you get your first check before you get your acceptance letter. It happens all the time..It sounds like you are on the home stretch. Fingers crossed. Best wishes.

Sounds like a winner to me!

Quite a few 'positive hints' in there......fingers crossed that you get approved !

Out of curiousity........How long ago was your original date ? Did something happen in Feb 2011 that made your situation considerably worse ? Did you start seeing a new doctor then who perhaps had more definitive documentation on your condition ?

Thanks everyone for your support, I sure hope it's good news and the Alj listened to the Ve at my hearing, but who knows my Alj has a 55% approval rating.

My original onset was 2006, this is when I was diagnosed with breast cancer (this was in one of two letters I received from ssa after first denial) Feb 2011 was the date I filed for disability, also started seeing a psych, neuro and Orthopaedic Surgeon during this time.

What was strange is one letter it stated I was disabled and disability began in Feb 2006 and in the same envelope another letter stated I did have some restrictions but could do other work (I guess your standard form letter):thud:

Again thanks all and any more thoughts on my hearing are welcome.

This mess will make you

I am in process of preparing for my hearing. After two denials the hearing is next step. I retained an attny for this and I remember him telling me something about SSD law requiring that SSD be decided within five years - I don't remember the details but that five year mark stuck in my head. So maybe that is why the change in your onset date? Good luck!!

Thank you for taking the time to help me.

You should ask your attorney why he changed the date. We do that kind of thing all the time for various reasons, and I'm sure your attorney had a good one, but you should ask just so you know.

30-60 days is pretty standard. You did get all the usual clues that it will be awarded. I hope so for you. Just know that you are now waiting for two letters. The First will be a big, long letter from the judge titled, "Notice of Decision." After that, you get to wait another 30-60 days (Though they have been coming faster) for a "Notice of Award." This notice will tell you how much money you are getting and when. And yes, sometimes the check beats this letter..

Good luck to you!

Hi Bambi

If they ruled fully favorible, you got the disability. The judge ruled the same way for me, at the hearing. I heard by letter several weeks later. The document will help you reliax. ginnie

i just wanted to know if ssi can tell you over the phone if you were approved or denied after seeing a judge:confused:

Mz Migraine 10-19-2012 12:23 PM

Nope! Remember, you're dealing w/the FEDS. :D

ginnie 10-19-2012 01:18 PM

Hi Liz

Sometimes the Judge will declare right in the court room. He did for me. However usually it is a letter by mail. I didn't believe what he said until I got the letter. I wish the best for you. ginnie:hug:

Their policy says "No".............and "Wait for the letter"

The wait can certainly be frustrating......

ginnie 10-21-2012 07:11 PM

About SSI

Most of the time they make you wait for the letter. Very frustrating. In my case it was granted at the hearing. Exceptions can be made at the Judges discretion. My attorney said I was lucky. I hope things work out for you. ginnie:hug:
