Update

Hi all, I know it has been a long time since I have posted on here. So much has happened. I became homeless and had 2 strokes recently (all of the pressure of everything finally caught up with me) and loss functionality of my right side. I have been through intensive therapy and regained some functionality of my right side back and am able to walk again but still have medical issues as a result of the strokes. Last post is when I was at the reconsideration stage. I was denied. I appealed (my attorney appealed for me) and went to alj hearing on November 27. I just found out yesterday that I received fully favorable decision and my claim is at the processing center. This has been a long 5 years... I am so glad to finally have received the approval. Now I can begin on putting the pieces of my life back together as much as I can. I am overwhelmed with tears right now as I have fought so long for this. I thank those who assisted me throughout the process. This forum has helped me prepare more effectively for my second application process with receiving disability benefits. Sorry for the long post.

I'm sorry to hear how difficult things have been for you, LDD. I hope that the small piece of financial stability that comes with approval will help you de stress and be better able to manage your health issues.

thanks finz...the process I am in now to receive the money is stresssssful!!! Because I have mental impairment I have to have a representative payee. I have been isolated from everyone so this task is very difficult. I received the phone call from local field office before I received my approval letter because they want to release the back pay asap. I am so clueless to this whole thing. I suppose my attorney's job is over because he has assisted me in obtaining the approval...where do I go from here? It is so confusing. One office doesn't know what the other office knows. My local field office rep kept telling me I was not eligible for ssdi and I am only approved for ssi. Welllll she was wrong, I have the letter that states I am approved for both. I tried to explain to her butttt because I am a "mental" case, no one listens to me. So here I am. Ugghhh...I am happy though and does bring a relief that I am now approved and can start building my life back. Thanks for everyone's support.

I must say...they moved me along very quickly...it's just my ignorance concerning this part of the process that is probably holding things up. I was approved by ALJ on March 5...notice of decision sent on March 8. Call on March 8 from local field office to do phone interview for SSI amount determination. March 9th the amount was given to me of my back pay ... SSDI is still being worked on by the payment processing center. Notice of award sent on March 13.

Depending on where you live, and the amount of backpay, you may want to consider buying a Single Fmily Home. If you won't have enough cash to pay for the fill thing, there is a program through the USDA for rural areas and those with low income to receive a subsidized interest rate 1-2%. if you don't have a family member that you trust to act as your representative payee, then SS provides one.

If you have bills that are several years old, don't just automatically make the payments along with inflated penalties. ( I'm not sure how this is handled with a representative payee.) the account that has your backpay can't be attached and your monthly benefit can't be garnished. These resources SHOULD NOT be going to a collection agency to pay debts you're not legally liable for anymore.

Please keep us updated, or even pm me if you need any help.

I couldn't agree with you more, Chinese water torture. In my case the judge says their own cherry picked doctors are lying.

So it took from Nov 27 to March to get a decision from an ALJ hearing? I thought it would take 2-4 weeks after hearing with Judge. I am new to this as well. Husband has an ALJ hearing coming up soon.

Happy for you

Hi Ib, It didn't take that long for the decision. My therapist initially refused to send my records even with signing a release ... the judge and my attorney informed her that it was illegal and the judge issued a subpoena at the hearing as these were the information required to make a decision. She also sent me to have a consultative exam with one of their doctors which happened on Dec. 3. The doctor didn't return his report until January 13 so it actually took from January 13 to March 5 to make the decision.

I imagine the times would differ from state to state. My case moved along very quickly even for our area. Hope this helps.
