I been on ssdi since 1997. I have been baker acted numerous times. I won't go on how bad involuntary commitment is, I just want to know if that"s on my police record and will ssa find out?

You might need to disclose it in a CDR, it would depend on the timing.

Were the holds for only 72 hours? Or were you ever convicted of a crime and then had to serve more than 30 days?

Are you receiving ongoing mental health care and compliant taking prescribed meds?

no, not criminal. never convicted of a crime. see doc and take meds. i just get suicidal sometimes.

how would getting baker acted affect your ssdi?and why would you have to report that before a review?

It's medical treatment/hospitalization. Not that needing to be hospitalized short term would effect a beneficiary's benefits.

but you dont have to notify them when you are hospitalized only later to answer the question on either the short or long form review

So the form will specifically bring up Baker's Act????

i have mental disability. i was told involuntary commitment helps you. not sure if its just for application, i feel if i cost medicare too much they will cut me off

SS has access to your Medicare records. So, you're disclosing the info or not won't make a difference.

The cost of your treatment, including Baker Act hospitalizations, won't be a factor in your continuing to receive SSI/SSDI benefits. Is there any advantage in terms of SS benefits to being hospitalized? No, not IMO. But nor is there any harm, UNLESS it's a sign that you're not adequately attempting to address your mental health issues. Ideally, you should be seeing a mental health provider weekly, and you must take your meds as prescribed.

If you choose to work and make over 50% of SGA a month, expect to receive the Long Form CDR.

No, the form won't ask about the Baker Act specifically. But question 6 of the Short Form (SSA-455-OCR-SM) asks about hospitalizations.

I have never heard or read of anyone being cut from Medicare because their illness and/or disability cost them too much! Medicare does not follow the same rules as health insurance companies because it is a FEDERAL program. Health insurance companies are governed by the "State."
