I'm still dealing with my school district........

I gave my school district a letter from my dr. saying I can return to work part time and that I have a disability. I received a letter from the district on Thurs. afternoon saying they wanted "more information from my dr...including what disability I have".
Mike and I talked to the ADA atty and he said we'll have to play the districts game at this point. He said legally I don't have to tell them what disability I have....BUT IF I want to return to work......I should go ahead and tell them the disability and have my dr. fill out the paperwork. :(
So tomorrow I have an appt with my dr. Mike and I have written out all the answers to the questions the districts has asked " What percentage of time can you lift, bend, sit, stand, walk yada yada yada!!!" So hopefully my dr. will fill out the paperwork in my favor.....I think he will. He hates paperwork and crap that companies give their workers. I'll let you know how it goes tomorrow....keep your fingers crossed for me!

Best of luck, Roxie. It can be nervracking and tough on the old ego. Hang in there.

MelodyL 08-19-2007 10:49 PM

Yeah, Rox. (Foxy Roxie),

Good Luck.

By the way, did you see what pics I posted on my thread "Foot Center"?. I took pics of Alan's boot.

And I explained how I put cotton balls between each toes to uncompress his nerves. He says it's working and his pn is much better.

Who knew that just stretching toes (like when you go for a pedicure and they put that thing between your toes), would help with his PN. But he is sitting inside and he said the pain was much better.

Hey, if it works, we do it.

Melody

Yeah good luck Roxie, but i am sure you will be right, anyway. :)

Yorkiemom 08-20-2007 12:43 AM

Best of luck to you, Roxie. I hope you get everything all worked out.

Good luck with your issues with the school. Just the stress of this can't be good for your PN, so hopefully this will resolve itself soon. Our schools here start this week, how about yours?

Off Topic: Hope "Dean" stays away from Texas.

Hi - I'm sure regarding what the law is now about detailing your exact disability to employer - but I know I required all my employees who were reuqesting reasonable accomodations to obtain an MD note.... also, if there was something that was a medical condition that could affect you doing your job safely, or perhaps a seizure order etc. that coudl require immediate action on your employers part, its important... (I worked at a senior level in HR - and I was often the only other person other then the direct manager who had these details - but were considered important)..... in some cases its not feasible to make accomodations, e.g. a truck driver who can longer feel their feet - it would be dangerous to all involved and the job could no longer safely be done by them..... anywhere I was - we were able to accomodate employees - but I also had a deal with them if there was an issue where they needed to be out, to contact me directly and until they could return to work with a doctors clearnance - they needed to let me know their status. Co-workers were never privy to this inforrmation unless the employee choose to share it... so atually sounds routine!

Also, the the nature of the business - complying with ADA is a federal regulation - so the employee needs to provide medical evidence.

Sending the best....

Its funny to hear about the cotton balls, but I'm certainly going to try it, as I have noticed that if I place my foot in a certain position with the toes separated it relieves some of the pain!

Roxie2007 08-20-2007 09:09 AM

HI! Thanks everyone for your best wishes.

KMEB, Thanks for that info. That relieves my worries some. I'll be glad to have all this craziness overwith!

Diane and Dakota, I do think all this stress has made my pn worse. I've been in pain all week. I hope once I get it all figured out I'll start feeling better again!

Mel, That's great news about the cotton balls working to lessen Alan's nerve pain! Some times it's the littlest things that help. You just never know till ya try!

I'm SOOOOOO glad the hurricane isn't coming to Texas.......I do feel sorry for those who are getting hit hard by it though.

Well I'm off to my dr. appt and then to the school.......ugh! I'll let y'all know how it goes!

daniella 08-20-2007 09:15 AM

Good luck. I'm sorry your in pain too. I thought they were not allowed to ask the specific why of your medical issues at your job. What does it matter if your doc says your unable if its from x,y,or z. Well good luck.

Hey

Baby talk more when get back from pt...Sue

Roxie2007 08-21-2007 05:52 PM

Well my dr. won't agree that I can return to work and lift 50-100 pounds, kneel, stand for a long period of time, etc etc etc...........So my school distict says I can't return to work under those circumstances on ADA. SOOO
Mike and I decided I'd stay on FMLA for another few weeks and then return full time to work and see if I can do it. IF I can't.......then I'll have to find a different job. This is my 13th year in the district so I hate to quit. So now I'm stressed over all that........ugh!!!!!!

Silverlady 08-21-2007 06:14 PM

Awww, no

Roxie,
I was hoping this issue had been put to bed. I'm so sorry you are having to go thru this.

Billye:hug:

Dakota 08-21-2007 07:19 PM

Roxie, I'm confused. They will let you work full-time, but not part-time?

Steff 08-21-2007 08:02 PM

roxie/teaching

i am a teacher too and i do not know how i will return to work in a week. last year i was on the lyrica, but not now. i was still in agony, but i need the money and health insurance.
i never have taken time off long enough to have them ask the questions you are having to answer, but i have great limitations. the best thing to do is to go back full time and then start asking for accomodations through your reps at the teaching level. you must have a union rep or a membership or something?
the reason they do not want you back is because they are afraid of work comp and will liable any injury.
most people your age or mine in perfect health could not do the things they are asking yu to do.
once yu are there and working, it is easier to ask rather than to ask and then try to go back.
in ca they have to give you any reasonalbe accomadations (i know i cannot spell for teacher it is awful) that they can before they ask you to go on disablitiy or retire.
there are many small things they can do, and that i do.
i use the elevator if i have to. i take my own stool out to firedrills
i borrow the extra wheelchair and have one of kids push me if we go far from one end of the school to the other. i have a mom go downstairs to run my copies, or i use the office one and sit on a chair
i do not do yard duty
i make students come to me with their questions or i call them up one at a time to ask them how they are doing-doesnt always work with crowd control,
i roll on my chair around the room.
i hate it -but i am doing it while i am waiting for my miracle.
i cannot do all the fun things in class i used to do, and it drives me crazy becasue i am very artistic.
anyway-go back first and then deal-and ask from advice from an outside school rep who in not your principle.

Roxie and Stef:

I have such respect for you people, I can't begin to tell you.

I have a son who has never worked a day in his life. He doesn't believe in it. And I read your posts and I say "wow, these gals are disabled and they still work". And my Alan works as a security guard from 12 midnight to 8 in the morning, Friday and Saturday.

Like I said, Proud as punch.

Take care,

Melody

Roxie2007 08-21-2007 09:37 PM

HI All!
IF I return to work full time.....and not use the ADA (American's with Disabilities Act) then I can just return to work with having to have the dr. fill out all the crap (sorry...I'm just fed up with them!), I just need him to sign that I can return.......period. He won't have to say if I can walk, kneel, stand etc....

Steff,
I know it's going to be rough going back full time. I work in a very stressful, very physical Life Skills Spec. Ed. classroom. I love it, most days. I hope I'm able to sit down once in a while and won't be dealing with the real physical kids. I usually take some of the kids to PE class so that going to be rough now.
I was missing one day of work a week the 2 months prior to finally taking sick leave. Now I'll have to take one afternoon a week off for my IVIG infusions. I won't mention that to the district till After I get back there! lol
I give you kudos for being able to work as you are. IF you need to go out on sick leave you can go out on "Family Medical Leave Act" for up to 12 weeks a year, that's what I'm doing now.

Mel, I think my son is a twin to your son! LOL We need to talk! LOL
