I fell
 
I went to a newer strip mall in our area. Parked right in front of the store, got out, stepped up the curb, started walking and down I went.

Stupid developers have different colored concrete so I didn't notice the GRAY strip as a step up.

The ladies working in the store saw what happened and gave me 2 names and numbers to call which I will do tomorrow. They told me they have had employees and customers falling since they opened in Dec. 2007. :ranting:

When in the hell did GRAY become proper for steps :ranting:

Please no sympathy, I'm fine. I have two bruised knees and the palm of one hand is bruised.

My leg muscles hurt - I must have pulled them going down or getting....obviously :rolleyes:

I feel ya snoopy. Sorry you fell. I know since I've lost depth perception, colour is very important in telling where things are.

no sympathy, ok klutz:hug:, i did that a few weeks back, on some stairs the color blended, it was same as ground and never saw first step, glad you didnt break anything, seriously glad you are ok regardless if its sympathy or not:hug:

Aww snoopy, I'm sorry you got hurt. I am not an attorney but I play one on Neuro. forums.. do you want me to press charges or file briefs against them?? I am going to take a sleeping pill tonight but if it doesn't work.. I will get $30 million in punitive damages and other legal words I will look up later for you!! I do hope you feel better :)

I have been reading the ADA website. I'm not sure who I'm going to call first tomorrow - The ADA to ask questions, the city goverment offices or the developers.

In my unprofessional opinion someone screwed up - HC parking is at one end of the section but if you can't do stairs you will need to go to the other end and back track for some business. It appears (to me) there should be HC parking at the other end as well. But, I could be wrong about this.

The area where I feel has nothing to indicate there is a step. If you have vision problems your going to fall just like I did.

This City usually does quite a good job with accessability.

Snoopy,

As a former P&Z commissioner, my suggestion is to find the City Code for parking. That's the first place to start. Usually it's online. Go to your City's homepage, or county homepage.

For our City, there is a ratio of HC parking/non-HC parking. The location is NOT up to the developer but usually close to the doors and not in a location that people would have to negotiate stairs/steps or inclines more than 3%.

You can call the City for the regulations if you cannot find them online.

I think it would be a good idea to go back to that spot ASAP and get a picture of the steps you fell on before calling anyone.

This is correct. ADAAG and individual state equivalents are vague, however, on this but the intent is obvious. I'm only familiar with Texas and Florida accessibility guidelines though.

Color is not addressed in ADAAG (ADA accessibility guidelines). Nor is it addressed in Florida UFAS or Texas TAS. I've been working at a federal institution (NASA) for a while now - we've gone from gray to black to yellow. I don't know what color we'll go to when the next person falls.

I would call the code compliance or zoning office for the municipality. You could hurt your head trying to research it yourself to see if it was in compliance. Whoever is the code officer should have that info at his / her fingertips.

I called the City this morning and was transferred to City Planning where I left a message. The person who returned my call was different than the person I left a message for.

I have been in and out today so I am playing phone tag :rolleyes:

I finally connected with the City person. My call got handed over to her because I mentioned I fell. She initially was trying to cover the cities butt :rolleyes:.....good grief

As we talked she must have gotten a clue I wasn't looking to sue. She is referring my call back to someone in City planning. I should hear from someone on Monday.

So, what are the odds anyone will do something? I'm betting zero.

Have you called the Director of the Public Works Department directly?

It is worth a shot if you don't hear from them on Monday.
