I'm up for a good fight
 

As you all may know I have lost the court case with my in-laws over the house. I am going to look into appealing the decision with the help of Legal Aid or a Pro Bona lawyer.

I also am up to a fight with my next door neighbor when she takes me to court next week for excessive loud noise. I have pretty much had it with people getting over on me.

Sorry that you are having to go through all this over the house.

And the sooner you get away from the neighbor the better.

My lawyer said I would not have a case to appeal the decision handed down to me with my in-laws. So I'll have to drop that.

My car insurance woman called me and said there is $100 damage done to my next door neighbor's car from the allleged accident. The insurance lady said my neighbor has a picture of our two cars together. I am working on that cause I did not hit her car. She set me up. And there was nothing but a half inch sratch on her license plate and that was it to say was wrong with it. I am fighting mad. I told the insurance lady that the woman got in her car and moved it into mine to make it look like I hit her car. So what she has a picture. She does not have a video of me hitting her car which she told me she did way back then.

Dear Barbara,
I'm happy that you have good car insurance and that you can let the insurance company deal with that.

You need to move as soon as possible and without announcing the date ahead of time to anyone.
If she is as crazy as it appears, she could act out more just before you leave.

Mari, my insurance company is not handling it becasue they believe my next door neighbor. I have to do all this crap alone.

Moving is not as easy as it seems.

Mari, my insurance company is making the claim to pay my neighbor so they did that part to get that far. I did not hit her car though so the insurance company should not be paying my neighbor a dime. I have been judged to be guilty just at the say of my neighbor instead of innocent until proven gulity. I have to prove my inocents on my own. The insurance company is not doing tha for me. Do you understand now? I was set up big time by 2 people.

Yes, I hear you and understand.

When you move, do not tell people where you live now. Do not talk about it and certainly do not tell them the date --- let them find out when you are moving your stuff.
You need to protect yourself as much as possible.

this is awful. i cannot believe (i mean i do believe you, but it's shocking) how the insurance company is just ready to pay out like that. ghhhhh. i would be ggghhhhhhhhh:mad::mad::mad:rrrghhhhh. yeah. i am really sorry about this. i wish i knew what could be done. can you get help through legal aid on this one?

i agree with Mari about keeping a low profile moving. i mean sure people are going to see it when you start hauling stuff out but let them find out that way, don't help them. sigh. at least you are moving. i know moving is hard. and you will be leaving your garden that you just planted. :( sigh. or can you take the impatiens with you? you did say it was a small plot. do be sure the mgmt has fixed the phone before you move yourself in to stay.

i do wish you well through all this. you really deserve a break. it just makes me want to scream just thinking about all the crap you've been having to deal with.

My Nerves are so shot aftrer the confrontation with my neibgbhor and her croonies yesterday that I just don't care at the moment. I'm just going to take Ativan and sleep all day.

can you ask to see a copy of that picture of the cars? to see it and explain -if it was a staged photo by the neighbor.

100.00 damage is pretty cheap these days- the ins probably feels it isn't worth a big investigation.

But that 100.00 comes out of your pocket doesn't it? under the deductible??

was it your agent that talked to you about it?
I'd really request to see that picture... maybe at the ins agents office so you can talk with her face to face, about this neighbor and what happened.

The insurance adjustor says that it's still picture of her car and mine touching each other like an impact. My next door neighbor got in her car and moved her car to touch mine so when the cops come he would see it. Talking to the insurance agent is a good idea. I will call them on Monday. My next door neighbor is good at her con game cause she knows the insurance company is not going to want to investigate something just for $100.

After me sending the insurance adjustor some photos she emailed me back today and said she will be sending the other party a rejection letter. I had made some pretty good arguements with the photos.

I go to court with my neighbor this Wednesday for her charging me with excessive noise. I have some surprise defense strageties that she doesn't know about. It should be interesting.

I just wish I didn't have to go through all of this and could just move on with my life.

Do you have a security camera outside so that you can after this protect
your assets. And then when she does things it would get it on tape too.

I do know it doesn't take a lot of money to get some of them. So if it turns out you aren't going to get to move soon. See about getting one.

I have a tape recorder to tape her and she knows it now. When I requested a copy of the denial letter from the insurance adjustor she emailed me back today and said that before she sends out the denial letter she wants to talk with the officer who responed to the call.

I feel much better after getting an email from Di not long ago. The only other thing I now worry about is getting caught up in heavy rain while driving cause I can not see.

I hope to run into my new crush today at the restaurant I go into all the time. I told mutual friend of ours to give him my phone number and call me. I told her that I wanted to ask him to help me check out a mobile home since he has one. I have not heard from him yet.

Now I have diarrhea again. Gosh, I wish it would get over with so I can be sure I won't get it after I leave.

The judge believed my neighbor and I can be facing jail time if my neighbor says the loud noise doesn't stop.

i'm sorry Barbara. This is just unbelievable. I don't suppose there is any chance for success with an appeal? What was her "proof" ... and what loud noises were you supposedly making?

Good luck with getting moved ASAP. Try to lay the honey on thick with management to get that A/C unit in there so you can go forward and get away from that ... that ... that ... "person" (and i use the term "person" loosely in this case :rolleyes::cool:).

I am so sorry. I had a nightmare of neighbors. They cost me close to five hundred dollars years ago when they put glue in my lock and prevented me from getting back into my apartment.
The wife attacked me and then I GOT A LETTER THREATENING EVICTION. tHEY used to let their little kids and their friends' kids play in the hall and it was if as they were in my apartment. This went on for ages. My bipolar got worse and worse. My mother was alsosick. If I had to do it again, I would have hired a lawyer. the weird thing was after a few years the wife and i became civil again.

Thanks everyone. A class one misdeomenor can carry jail time here in my county. My next door neigbhor told me a couple of weeks ago that I was going to prison and this was her way of making that threat come true.

I am going to try to get a public defender.

a professional might be able to catch her up in her lies some how.

now take a deep breath and try to find something to do this evening that will take your mind off this for a while. or maybe just take something to help you sleep, and sleep. but i like the idea of doing something else for a while to shake things off. and then get a good night's sleep. with meds if need be. :o

It is crazy....this means that anyone can say anything, slanderuos or anything and it is here say as to what the judge will believe.
He said she said...how do you prove this????

That's what I can't figure out.. she must have had notarized letters from someone or something??

You would think if noise is an ongoing problem in any apartment complex that management would have been notified first and there would be records showing that they have had complaints. If they are doing things properly...anyway..

Hi all,

She had no sworn statements but I did. The judge would not read my sworn statements and the judge soley ruled on what my next door neigbhor had to say.

After some online research I found out that I was charged with a a more serious crime than I was accused of. I was charged with a class 1 misdemenor which can carry up to a year in jail. What I was charged with does not fit the crime I was accused of which was excessive noise. My neigbor said the excessive noise was me talking and laughing on the phone late at night.

Things are becoming clearer to me now. I have a good reason to believe my county is corrupt and my next door neighbor is benefiting from it. I truly believe now that my next door neighbor must have paid for a favorable decision today.

All I can do is move and stay out of her way. If I thougth I had a chance I would sue her for slander and harassment but the way things are looking corrupt in my county I don't dare do that. I don't know the extent of her connections.

and they didn't give a warning to you?

gosh I think around here they warn a few times and then give a ticket/citation
and then depending on if you go to court or not then a hearing..

If you feel like it maybe call a legal aid place for advice...

I don't know if it is worth spending any money on, if it hasn't cost you any court fees or fines.

you might look online for legal sites for your state and do some reading about similar cases.

Can you rearrange your furniture to block as much sound as possible to the wall facing her place - bookshelves, even a big wall hanging would help block sounds.

But i just don't see how any court would even spend time on a one time noise violation case??? unless something there is really messed up.
just doesn't sound logical to me at all.

Did the police give you a ticket at the beginning of all this?
