Federal OWCP

Hi everyone,

I'm toward the end of the cycle with my OWCP but am having difficulty getting the DOL to accept RSD as part of my claim even though it is obvious that I got the RSD through my work injury.

I have been "permanent and stationary" for 2 years now. I have got permanent restrictions and a 96% disability rating for my right (dominant) arm. I have had two visits with the gov's 2nd opinion doctor. My examiner said that they won't settle my claim because she says they have only accepted "sprains" as my diagnosis and she believes I'll fully recover - even though my injury was over 4 years ago.

Since the claim is federal, I haven't been able to find a lawyer to help me out. I am tired of being in the federal system and I just want out. I want to settle my claim. I do not want their kind of insurance since it takes weeks-months to get anything authorized if it ever does get authorized. Not many docs will bill to OWCP anymore. If I can get this settled, my private insurance has said they will cover the condition, but they need to have me be outside of the OWCP umbrella.

Any advice is appreciated.

You should call these guys. Even though they are in another state they know the FED system inside out. I bet they can give you some help..

Some have written letters to their senators , governor and any other officials to try and explain to them about chronic pain and injury and how the "system" is not working properly.

If you check some of the older posts here you will find that info.

Some things that might help-
dr/drs notes, charts, testing- clearly written in a timetable format??
= your full history, diagnosis, and all symptoms as they appeared
and a clear firm statement of how the RSD is related/caused by the initial injury and how it is a long term diagnosis for the most part.

Do you have all copies of notes, charts, tests, bills.

I think very much depends of the reputation and knowledge of the dx'ing and tx'ing drs .{diagnosing/treating}
And how confidant & firmly they write the reports.

But that is just my take on it - many in CA all over really are having a lot of trouble getting chronic claims accepted.

Good luck - it is a tough thing to go thru.
