I had my hearing on Nov19th,2013. My lawyer was asked to appear before the judge. She came back out asked if I would drop my ssdi claim, and change my onset date. I agreed. Spent 5 mins in there. He didnt ask the VEanything.I still havent heard anything. Worried. Has anyone else went thru this?

I am a little confused. You had a hearing, the hearing ended, but the ALJ asked the attorney to come back in, the atty came back out and asked if you would "drop" your claim? and change the onset date?

My ALJ asked my atty if I would change my onset date during my hearing. The ALJ suggested that my atty and I go in the hall and discuss it off the record and return with a response. We stepped into the hall for about a minute and returned and agreed to change the onset date. In my case, it made NO difference in benefits or anything so it was fine. Where I am confused is asking to drop your claim. Do you have a claim for disability AND also a claim for supplemental income benefits? I was under the impression that they are handled separate from each other.

What did your atty say to you? The atty went in without you? I find that very strange to begin with. I do not know why an ALJ would have any private conversation with an atty outside the presence of the client. Maybe I have just mis-understood your post.

Yes I had both ssi and ssdi. The judge called her in came back out and said if I agreed to amend my onset date and drop the ssdi. She said he sound like he would approve my ssi.

I am currently receiving medicaid. Will that also affect the ALJs decision.

disability hearing
 
My hearing took 5 minutes. The VE didnt testify. Agreed to change my onswt date. Its been 47 days. Should I be worried?

No.

Or, more correctly, it shouldn't have anything to do with the SSDI/SSI approval process regarding whether or not you are totally disabled.

From what you've said here, it sounds like the judge may not have seen evidence of total disability earlier in your claim when you could have still been under SSDI based on your dates of eligibility, but would be inclined to find total disability NOW when you would only be covered by SSI.

Was there a big difference in the numbers ? I think that would be a hard decision to make on the spot. As you agreed to the judge's requests, I would think the judge would follow through with his implied part of the deal. It is frustrating to still have to wait awhile for some resolution after what must have sounded to your lawyer like a "done deal." I hope that it works out for you and that you hear soon.

It's usually best to keep questions like these in one thread, so that people who respond can see all of the facts/history together. You tend to get more thoughtful, knowledgeable answers that way.

I do "get" that it can be hard to wait for answers when the matter is this important and you've been waiting to hear from the SSA since November. I responded in your other threads.

Ok Im new at this. To make a loñg story short. Had my hearing in Nov 2013. The day of my hearing the judge asked to see my lawyer. She went in came out, and said would I be willing to change my onset date. I said yes. We went in the judge asked the VE nothing. Asked if I would agree to what my lawyer had presented me with. I said yes, he said thank you have a nice day it is now at the decision writers for 10 days today. Im worried he will deny me.:confused:

Thanks, but I knew that part of your history from the other 2 treads that you started. As there have already been a few responses regarding your issues, with additional questions that you clarified, it seems like the most info is in your "Worried" thread. I wrote my answer to your concerns/questions there. You might want to refer all other posters, if they happen to respond here or in your "MA" thread, that the "Worried" thread is your primary one, at this point in time, to keep all of the info, answered questions, discussion, etc in one place.

No harm, no foul......You absolutely did nothing wrong by starting more than one thread. Lots of newer posters do that not realizing that they will save themselves, and the responding posters, time and effort by keeping all of the info together.

I'd be climbing the wall if I was waiting for word, since November, about what sounded like a done deal.
