Per w/c:

"The insurance company paying your workmen's compensation benefits has apparently decided you are able to return to work, They have filed a petition with the Industrial Accident Board to terminate your workmen's compensation benefits. Ultimately, if the case cannot be settled, this will result in a trial before the "Industrial Accident Board, in Which Board will decide whether or not you are capable of working, if they decide that you are not, then the insurance company will be ordered to reinstate your workmen's compensation benefits. If they decide that you are able to work, then your compensation benefits will be terminated."

They will stop paying my w/c benefits. However, my weekly check will not terminate. my case is pending before the Industrial Accident Board of Delaware. So, through the Second Injury Fund, it will pay my w/c benefits during the time my case is pending". If I win, W/C will owe this to the State of Delaware. If I lose, I don't owe anything to Delaware.

What the HECK? How do they know what I am capable of? OH YEAH...I just had my IME from the defense...who diagnosed me 3-5% when OUR doc diagnosed me 50%. HMMMMMMM.......wonder what's up with that?

I am sorry that you are going through all of this garbage, I do not know anything about w/c, but it sounds that they think they have some concrete evidence on the EMG. Where does your doctor stand on this, and why such a large discrepency on the test. I just hate to see everyone go through all of the emotional stress while trying to manage this illness. Isn't it enough that we just survive each day to the best of our ability. I will keep you in my prayers and for those who are passing judgment on you. Be strong and try not to get to stressed out, I know easier said than done.

i'm sorry. i tried to go back to work at one point, but it was obvious that i just couldn't do anything except take a pain pill when i got there and then fall asleep at my desk. that didn't last long. i hope you'll be able to avoid anything like that. i don't have any information or experience with wc, but i hope there's a way to get the care, ruling and compensation you need to help with your treatment (and hopefully recovery) from this

Have you heard from the Dept of Indutrial Accidents about seeing their IME doc ? Mine was as big a joke as the WC IME was

They are just protecting the profit level of the ins company...:(

Believe me I know it all feels personal...

motto - IME doc is NOT my friend!

Your atty and your doctor/s need to refute the denial & that IME report with the medical records and any other tests or PT records that can show the consistency of symptoms as they noticed and that you reported to them over time.


Maybe it was a typo?? atty should contact dr and ask ... could be he meant 30-50% - ya never know unless you ask/verify right??

There used to be some really good posts on a old WC forum telling how to do deal with a lot of this stuff - but it was all lost in a major website crash yrs ago.
I can only recall bits of it.

Dear Kim,
I know it's a treacherous ride right now...just reading about it renders me a jaguar ready to ponce and grrrrr.
In the New York times article posted a few days ago about IME exams, it reads that the exam results can be contested and brought before a judge and that some exam reports are actually rejected..
Don't give up, Kim, and try and stay focussed and balanced..I know it's easier said than done... after a QME I had last month, I was disgusted over how superficial it was....

Hey Kim, EXACTLY -I'm MAD TOO FOR YOU!!!!-how do they know what we are going thru, how some days we can't get out bed. Yesterday, I was measuring a window-two measurements-well guess what, I couldn't remember the first one, but the last one, I could. That's pretty simple-two measurements, but only could remember the last one. I did this over and over again on all the windows in the home we are moving to. I finally just did one at a time. No wonder my husband started transferring all our business call, I could never remember who called or what they said. That's what 15 years of this junk does to you. Now 15 years and full body and internally.Not to mention Trigeminal Nerve- That where you feel an ice pick is stuck in your temple. fibromyalgia, Diverticulitis, PTSD-complicated parents death and finding my father. Now need to be tested for RA. and Sleep Apnea. Also fell at an EXXON station putting air in my tire. I reported it to the manager. I didn't know I had RSD, wish I would have pursued damages, because now the RSD causes so much pain in my neck and headaches that are BAD. The air hose was faulty and retracted suddenly, throwing me back and rupturing a disk in my neck-a MRI showed. The stationed took the air hose equipment out during the night-the next morning, when I went over-a brand new one was in it's place. Also, got up one morning and passed out-hour and half-crawled to door-couldn't stand up and got my husband attention. He was upstairs at his desk-heard me get up, but didn't come down till he heard the pounding. He called 911-paramedics told him I was dead-I had passed out again. Very traumatic for him. I don't remember going to the hospital, but was in semi-icu for I think 4 days, my husband says 6 days. This happend because my blood pressures dropped suddenly. Most of us generally have high blood pressure from the sympathetic nervous system, but the para sympathetic nervous system lowers the blood pressure. I check mine nearly every day and journal it. The machine only cost $30 at Costco.

A couple days ago, my husband applied for SSDI for me. I'm 62 and haven't worked for quite a while. I dread going thru the red tape. I hope you get some justice with your WC case. I hope my case doesn't drag out. I don't think I could handle denial after denial. I have already talked to attorney and they will step in if I get denied.
