Benefits Finalized
 

Hello Everyone; I got confirmation yesterday, by letter that my claim for benefits are finalized. I am now officially cut off!! It is felt by the "case management team that I have the transferrable skills to work as a retail customer service clerk @ 40 hours a week of course @ a sedentary level". I was deemed at a wage unrealistic, and because of this there is no long term disability. It's just me and my care allowance of $70.00 a month. There is no retraining. My Doctor has not released me from care yet (to work), I have an appointment with a physiatrist this Tues. am for possible trigger point injections. I am truly hoping to be able to relieve this pain, and get on with my life. I truly feel abandoned and abused by this system. I can honestly say no one has ever treated me so poorly, I really feel violated and dirty.

Was the the final judgment from a hearing or a judge?

Or just the decision of the Ins company?

If by the Ins company only - you should be able to appeal the decision??

in the US as far as I know - we file the claim, it gets get accepted or denied, if denied then we can appeal that- most do get a comp atty at this point-, then we usually get sent for an IME or 2 at some point also, then it drags out for a yr or 2 til the hearing is finally set up.

In my case we went for the hearing and the other side asked my atty if we would consider settlement negotiations {my 2 docs still were only calling it a chronic RSI injury with chronic soft tissue damage- but I also had 2 separate shoulder injuries during the last few yrs so that added in too}
so since none of my docs knew enough about TOS to give a firm dx of it -I agreed to settle.
{plus I was doing much better with finding my chiropractor during this same time}.
I need no meds just monthly chiro tx - but I haven't returned to work yet either.
I will have to be very careful of the job I apply for because I don't want to aggravate anything.

70.00 a month is only 840.00 for a year???
are they going to pay for continued injections and any meds that are needed?

Did you have an atty?
If you can appeal this - definitely do that


PS- OH I see now - this is from the case management team only--appeal it!!

Hello Jo; This decision was from case management team, worker's compensation. Yes the 70.00 mon. is for a care allowance! Which was granted through a policy ( home care and independance). I am going to appeal their decision! Here in Canada we contact and are advised through worker's advocates, they are lawyer's that work for injured worker's through the appeals system.
I am so hopeful that I will be able to get help from the Physiatrist(appt. is this Tues.) My injuries, repetitive strain injuries as well. I think trigger point injections may be offered or possible cervical blocks(not sure yet). I know many have had these from reading some of the posts. Not really sure what to expect??
If anyone wants to comment, I'd appreciate it!! Trigger point injections? nerve blocks??
