Ime
I just got a letter from the insurance company that over sees my work comp injury. They are trying to make me do another IME when I just did one 3 months ago. Why? Because this doctor like all the rest said I'm injured and it's work related. Has anyone else had this problem? I've been on work comp for over 13 year now and had 7 IME's. They continually change attorneys and each does the same steps the others did.
The insurance company for Choice Hotels is Gallagher and Basset and they are total jerks. We've been to court many times and each time we win. The last time the judge said he didn't care what the name of what I have is...it's work related. You'd think that would end this wouldn't you? They could have settled with me 10 times over with all the money they have wasted trying to get me off WC, the PI, the IME's and the rest of the crap. |

I'm sorry for the hassles, but happy for you having WC insurance for 13 years. Mine came from bad surgery, but Dr. shooed me off and 4 years later found out it was RSD from the surgery. I had gone into remission a couple of times and didn't realize the scope of RSD and how it can come back and spread. Now have full body-14 years and internal. And no insurance ..... But I'm grateful for a wonderful Dr. and family that are so supportive. Grateful for this forum of supportive friends-have learned so much here. Hope you stay and get to know some great people. Keep fighting, you deserve insurance coverage-some states have lifetime insurance from WC injuries. Hope the best for you. loretta soft hugs:grouphug: |

You might want to have a conversation with your attorney regarding the possibility of a "bad faith" action against the carrier. Apparently, the law regarding the availability of such claims difffers quite a bit for state to state, but I just found this on another board, one in which you might have an interest, the Injured Workers Forum of WorkersCompensationInsurance.com, http://www.workerscompensationinsura...rum/index.php?: 06-30-2009, 01:35 PMhttp://www.workerscompensationinsura...play.php?f=761 And in a report of a trial court decision from perhaps an even more civilized jurisdication, check out, from the blog Insurance Law Hawaii: June 11, 2009http://www.insurancelawhawaii.com/in...bad-faith.html For what it's worth. Mike PS Then too, don't overlook Neurotalk's Worker's Compensation forum at http://neurotalk.psychcentral.com/forum30.html |
In summary, though it doesn't seem like it, by their actions, the insurance company is SCARED. Believe it or not, this is a good sign (though I am sure it doesn't make you smile). I too am going through worker's comp, am currently going through litigation, and despite the dozen or so docs (including 2 IME's) before they cut off my TTD benefits in October of last year, despite all that, I had/have to go to 3 more IME's! A year later. Again, this being because they are scared. If you don;t give up, keeping fighting those bastards, you will, like I will, and the warriors that come after us, make it through to the side where th4e grass is greener. Does that delaying the process and the do the games W/C play, with human lives suck? Hell yes. But, if u get frustrated, give up, while they appeal this little thing or that little thing, then they win. All of this is a positive sign from you end (positive in that they are scared, thus the IME's). And, if you can make it through and past these last few hurdles, which they are hoping you won't, you can stand strong and prove them wrong once again but showing up in court, finally, on "judgement day" when you get your final day in court....
