I recently read a post here that talked about RSD being excluded from your state worker's compensation coverage.

I would appreciate it if someone could send me a copy of that law; it will be very useful in an article I'm writing.

Also: I wrote a post at the BT Forum titled Why RSD Pain is Different. It's the one in which I describe how anyone can replicate allodynia simply by applying a blood pressure cuff, raising the pressure to above one's systolic and then waiting 30 minutes.

I can't find this document, nor any drafts, on any of my CDs and sure would appreciate a copy if anyone saved it...Vic

BTW: DON'T TRY THE BP CUFF THING. I suspect it may be the surest way to develop RSD in that arm.

I did a little research on the california workers comp laws, and found that they still recognize RSD.

Forums locked up!

Well it seems they locked up the old boards, even though the site admin says they still have them. He says they might be corrupted, so they wont put them up yet.

He did say they are intending to have them as read only......what I found in Oct of 2006, but now cant access lol.

I've just spent well over an hour going through Cal Workers Comp statutes - which I never had to work with before - but still can't find anything, even though I know it's there. (Maybe the regs, but presumably it's in the statute.) I've put in a call to a pretty good friend of mine who does this for a living; the guy who confirmed the exclusion for me some time ago. As soon as I hear from him I will get back to you.

If you read down into the document, you will find where they are rating disabilities. That is where you find they talk about rsd, and pain as a disability.

Mike that does sound right about the govenator passing that law about people abusing the system with fibro, and rsd. I also couldnt find anything on it, and I even perused the codes.

I tried to get a workers comp case going after being told by the manager of the casino to lift a keg of beer by myself. He couldnt spare a helper for a couple of minutes. But alas I was S.O.L. again because my employer was on native american tribal land.

They are not held to the state laws, and even federal for that matter. If you have a grievance you go to the tribal council...........like your gonna get justice there :rolleyes:

So for me it was cant sue the doctors, and no workers comp case. Even though I probably could have lifted the keg before the doctors oop'sed on me. I learned that before working at any tribal owned business, get everything in writing. Otherwise tribal sovereignty rules!

HI

I have a friend who emailed me today that she finished up
her worker's comp court case in California last week.

She got a 100% total disability with a medicare set aside
so she will not be faced with any problems
getting medical care.
It is all set aside for her in an annuity and if that was to ever run
out, medicare will pay for all her needs.
It is the most successful case I've heard of in California in the
past five years.
