Anyone deal with FMLA?
 
Hi All! :)
Having a lumbar puncture tomarrow. Trying to get FMLA approval for my husband to get off and take me. He works at factory and are on a point system
for days off. 10 points you are gone, he has worked for them for 35 years. Never abused the system, but same rules for everyone. When he picked up the forms from HR, he told my husband he needed a diagnosis and Dr. signature for sure. In looking over the forms, I saw no spot for a diagnosis, and of course you all know I don't formally have one, actually the last time I was there, last week, he said Demylinating disease with unknown etiology.
Anyway, I have had three visits with this Dr.(new neuro) this year, which he filled out and put on the form, and also wrote down I was currently doing physical therapy, which I start Friday. Is that enough to show Serious Medical Condition?? I hate this stuff. :eek:
Guess I don't have enough stress, if they don't approve, try to get my DD to take me. :(

I thought it was more for long term time off - like recovery after a surgery or a major broken bone, new baby...

- but a day here and there should be able to be approved by the HR dept, esp if you can talk with them and explain that the all the testing is probably going to be sporadic and no set schedule.

At my former employer the HR person helped me fill the forms out.

Can he get a vac day pre approved for a day or 2 off?

You might want to save the FMLA for later on if needed.

I guess I will be applying for FMLA at my job, so he can accompany me to my appts without getting a point against him. He doesn't have any sick time or personal time, only vacation time. Once I get approved It is good for one year. Trying to get away from him taking his vacation, as he has been working 10 hour days and seven days a week, since last May. The only time he can get a weekend off, is to take a vacation day on Friday, then he gets Sat & Sun off too. This overtime is manditory. They are on a 10 point system ,so he now has 4.5 points. They also have denied his vacation too, twice within last two months.
Still going to do my test tomarrow. Guess we'll see.....

Yikes - that is a lot of hours & days a week - I hope he is taking care of his health with good nutrition & extra vitamins..

My dh did some short stints of mega OT like that a few times -but luckily it was only a few weeks and 3 months at a time.

I found a Wikipedia article that explains the FMLA rules/regulations etc...I was on FMLA the last year I worked so I could just work 3 days a week and still keep my insurance. States have added things to the law, so it could be different in Iowa. Hopefully this will help!

Intermittent FMLA is the usual title for this. You can use FMLA for scheduled and unscheduled appointments and hospitalization as long as you have worked 1250 hours in the past year, or if you have a family member who is ill and needs you with them.

Your husband would have to apply for FMLA through his own company to use this to accompany you.

There's a lot of other requirements, such as the number of employees a company has, etc, so read the federal FMLA act AND your state's FMLA act. Some states have better laws than the federal law. The federal law is the standard.
