Good morning Dan my name is Jeff and I'm looking for some information in regards to a disabled persons legal rights. I've read a few of your post and it look like you've done your home work on Social Security Disability issues.

My social security disability claim was approved in June 07 by the ALJ and I received my award letter in Oct 07. Wondering if there is any legal recourse in regards to the SSA not issuing my check for back payments owed ?

Any Ideals, suggestions or websites that address this type of issue would be most helpful

Good afternoon, Dan Thanks you for your reply, Yes I could use some help. I read your post very useful information on the appeals process, I passed that information on to a friend of mine in Seattle who is now at the Federal level of appeals, does not look good, but facts are facts. I've also read the ADA and there does not seem to be any information in the act that applies to Social Security Disability, did I miss something.

Like yourself I've been in this process for 4 years now. Received my Favorable decision in June 07 and my award letter in Oct. 07 I still have not received my back payment check for monies owed. So I'm looking for some information on what the laws are and the rights of a person who is legally disabled. It does not seem right that the SSA can and does withhold funds that have been awarded by an ALJ and they had this information for 5 mouths now. In the real world 30 days is considered a reasonable amount of time to process a claim. If you have any ideas or suggestion I would appreciate your feed back. Jeff

Jeffn,
Call your social services office and ask them. I know they have 2 year from the time you are approved to send you all the back pay. They can also send it in several checks if it is a large amount. Your lawyer can give you info on this also. Go to www.ssa.gov

To MONICAD 1974. Thanks for the feed back. I contacted my Congressman about this issue of back payment and they are doing and inquirer and why these funds have not been processed. It looks like it is a hurry up and wait. I do think that this run around the block by the SSA is going to come to a stop after this election. Jeff
