good aproved today gang!!
 
well after almost 3yrs of pain(emotionally and physically).i got a letter from the "SSDI".yeah i know a lot of you folks got a phone call from your lawyer.its funny though.they said i will not get my first check for a full 5months.which will be feb 2012.they said by there records i became disable on my birthday(8/5/2011:eek::eek::eek:).why on my 55th birthday.i told them i was a heck of a lot earlier than that(10/8/08).but still i like to especially what to say thanks to "Ricky"he was right about his tips on getting approved:wink::hug:...and thanks all of you(legalmania,shellback,ginnie)for always being there:grouphug::grouphug:

I'll try to explain. The standards for disability differ depending on your age bracket. You have a better chance to retrain and learn to cope with your disability the younger you are, is the idea behind the policies. 55 must be one of those signifigant age brackets.

The downside is that you won't get backpay and are required to wait. You can appeal the decision to try and get the earlier onset date, but you do jeopordize losing the approval. You can't just appeal the portion you're unhappy with--you have to appeal the entire ruling. The onset date can also effect your monthly check, so that is an issue you need to check into as well!

If you have an attorney, they will likely want you to appeal because they're compensated from backpay. Don't let their interests sway your decision.

Doesn't the judge's decision address why you didn't qualify with the onset date in your application?

I was just looking at your older posts and it said your attorney had you reapply. If this ruling was based on a new application, then it changes your backpay and eligibility dates. The 55 birthday date is a factor, but can you confirm the date of the application you were approved from?

thanks litlove :)enclosed in the letter they told me how much my monthly payment would be and when it will start

Was this ruling based upon a second application?

If so, I believe your first application will continue forward, in which case you can probably pursue backpay and any monthly payment reductions without concern of reversing this ruling. These are important issues that need to be verified with your attorney.

AWESOME!!!! Don, that is great news about your approval. I know the agony of waiting. I am still awaiting my letter.
