Our excellent government leads the way in effiency again
 
I got a call from my lawyer that they were notified by SSD that I had been over paid and that my lawyer had not been paid. SSD is going to ask me to return a portion of my back pay.

Just when I thought I was done with the paperwork. Well thank goodness I put it in savings and haven't paid all my med bills yet!

Ask your lawyer to send you a copy of that letter from SSD.

Mz Migraine, I AGREE!! SSA took my lawyer's portion out BEFORE sending me a check. :)

If this is true, you should have received a copy of the letter from SSD yourself. They would have had to notify you directly also.

I'm glad you haven't spent it all yet....just in case.

I've never heard of a case where SSA 'forgot' to pay the lawyer out of your backpay BEFORE issuing your check.

I would wait for communication from SSA to see how they want to handle it. I hate to think there could be a lawyer out there trying to double dip with an unsuspecting disabled person, but....better safe than sorry. If SSA says to mail them a check, or that they will take a portion of your monthly checks going forward until the debt is repaid, that's one thing, but I don't think you should be conned into sending the lawyer a check.

Good luck with getting this straightened out.

I would say check with SSA on whether or not they paid the lawyer. They most likely did. Years ago my mother got approved for disability with the help of a lawyer. He sent my mom a bill and SSA paid him as well. He double dipped and I believe he knew what he was doing as this was not his first disability case. I don't believe all lawyers are crooked but I don't know if they have changed the process or not. I think they had moved to the SSA paying the lawyers so people wouldn't get ripped off.
