Help!
I have been going threw this prosses for 2yrs now! I was denied the first time and it took 8 months for them to send me my denial letter, so i got a lawyer and we apealed it and so i had to start the prosses alllll over again which took another 6 months, so then i just got the paper work to give to my dr and he faxed it to my SSDI office and sent me a copy and i looked over the copy and he basically didnt put down my mane dignoses that are the reasons why i need to be on disability! He just put down the issues he sees me for! I called him and he said he was sorry and wanted to know if he could fix it, obvisly it was to late because he faxed the paper work! I tried to contact my case worker but she didnt call me back. I am terrified that im going to be denied again and ill have to start it all over again! Anybody else have simaler issues? or have any insight on what should i do?

the doctor appears to want to help you. take him up on his offer to redo the letter including other medical issues you have that he doesnt see you for and forward it. because he has already sent a letter on other medical issues does not preclude him sending another letter on additional issues.
usually the doctors only write about the medical issues that they treat. if you have other doctors for your additional medical issues you should try to have those doctors address in a letter the issues that they treat in their specialty. social security will give greater weight to the opinion of a doctor in the specialty for which they are treating you. |
Hello tos8
Yes, kindly ask your doctor to re-write the letter, stating in detail just what is wrong. This was the kind of letter my judge read, that granted my disability. Your doctor sounds like he is trying to help you, but may have left out some of the information you really do need. I wish you all the best in the long process of getting disability. These letters, outside form letters, are very important. The more detail, the better. ginnie:hug:

The most important doc's report/form/letter must come from the doc treating you for that issue/s.

In my case is different, I have two Attorney's, one for my work comp. and one for my ssd. My Doctors don't write anything down for work comp. with out a big fat check first in the mail. Sorry just venting, legal stuff they won't do for free. BUT ! for my dis. ret. from my union, that letter came from the doctor's legal dept. I talked with a person there on the phone many times. s
She was great, looked over the doctors notes, called ME asked ME ?"s wow, was approved ret. asap. Other people told me doing the ssd paper work will take forever and ss is never happy with your last paper work. So I have an other Attorney for that, up to $6000.00 max. of my back pay. But I am on very heavy drugs and can't help myself and my wife is a mess because I am. There must be some legal dept. Your doctor works with. Or they might know of some legal team that can help you for free ? maybe ? Keep calling around, there might be a pre law person with a good soul that will help you :] |
I honestly dont know what to do. Im going to call my SSDI caseworker again this week and ask for the paperwork again and see if they will allow my dr to fill it out again, but when they had my dr fill out the paperwork last time as my case worker said "This needs to get back withn 10 days so that way your case doesnt stay open long", So im afraid that they will say no. Im going to call my lawyer again, but man he just doesnt want to do anything it seems, the most hes done is send in some paperwork to apeal it and that was it. Ill just keep trying.

Hello Tos8
I am truely sorry your lawyer has not kept on top of your case. If this fails to go through, or someone at SSDI drops the ball, it is your lawyer that is suppose to follow up. I hope you can find someone who can allow you to have some peace in your life while all the business end of it is taken care of properly. I will be thinking of you. I know how hard it is to wait for funds desperately needed. ginnie
