Paying back Cash Aid
 
I signed a form with the Welfare Office saying that if I ever got approved for SSI that I'd have to pay back the Cash Aid I'd been receiving from them meanwhile.

I saw on an another message board that sometimes Welfare only makes people pay back half of the Cash Aid they owe back, or even less. Does anyone know about this? I'm in California.

What if they take the whole Cash Aid back that I owe them, and it's more than my back pay? Will they keep taking my whole monthly check til it's all paid back or will they only take part so I'll have something to live on?

Your agreement probably says that SSI will pay back your interim assistance for the months you were eligible for both interim assistance and SSI. For the months before you became eligible for SSI, SSI will not pay back that interim assistance. Doesn't mean you don't still owe it back.

It will be paid out of any retroactive benefits (back pay) due you before you get it.

What are the months that I wasn't eligible? My first claim was from June 2011 to May 2013. I was denied that entire claim. I first began receiving Cash Aid in June 2011 and I am still receiving it. What determines eligibility for SSI? My second claim began June 2013 and is in appeal.

If you are approved and if SSA determines date of onset for SSI to be June 2013, then SSI will pay back interim assistance beginning with June 2013. Your county may bill you for the rest, but SSI will only pay back the months of SSI payment.

I live in California. I sign up for cash aid in June 2014. The judge clerk told my lawyer, the judge approve SSI Dec 2015 for me BUT she change my onset date from July 2015 instead of Feb 2012.

How does this work for paying off welfare office and lawyer fee?

Anybody lives in California or first hand knowledge?

When you use the term Cash Aid are you referring to county funded General Assistance or federally funded TANF/AFDC/CalWorks? If you don't have minor children, I assume you are getting General Assistance.

You also don't mention your application date. SSI is never paid before application date even if you were found disabled earlier than application date. If your onset date is July 2015, then you are eligible for SSI payments beginning August 2015 and the General Assistance (also called Interim Assistance) will be reimbursed for the months August 2015 through the month before the first regular monthly SSI check, which might be January 2016 or maybe February 2016. You may still be billed by the county for earlier months but SSI will not pay it for you. Some counties do this through an automated system; others do it via paper requests. The county will send you a list of what month they are requesting reimbursement for.

The attorney fee is based on all SSI paid from August 2015 to the month before your first regular payment. 25% if that is what is in your fee agreement.

Have you been paying the market value of your rent since July 2015? Or do you have a written loan agreement? Or have you been living for free with a **promise to pay something someday?
