Sister on hospice Soc Sec hearing tomorrow
 
My sister filed for Soc Security a very long time ago, many denials. But now she was sent home from the hospital with hospice care end strange liver failure and bowel bleeding. We pray for the best, but it's not looking good.

She was given the hearing, but has no new documents for the hearing tomorrow. I'm concerned that she should have gotten an attorney to help her at the hearing in case the original information only is considered, or will they allow her hospice case worker to present new records?

Just confused and worried about her well being and a way to pay her bills is so stressful for her. She is only 55.

The ALJ will allow new records to be added as well as testimony. Things for her to consider: The ALJ might simply give her a Fully Favorable Decision on the record, but if things don't seem to be going in her favor, she might consider revising her Alleged Onset Date if her condition worsened and/or her documentation improved at a later date. or simply because the standard for approval drops at ages 50 and 55. She should verify when her last insured date for SSDI is. (If her application is for SSI than it isn't an issue.) This could mean her giving up a significant amount of back pay, but she should at least be aware of the option.

I represented myself at one ALJ hearing, and had an attorney at another. I received a Partially Favorable Decision with the attorney and a Fully Favorable Decision on my own. I found the ALJ bent over backwards to accommodate me when I represented myself.

If she truly feels unready and would like to hire an attorney, she could probably postpone the hearing.

I appreciate so much the information. I haven't had a chance to see how she made out. Because she didn't text with news I am assuming no news yet.
I just hope she filed SSI and SSDI.
