Overpaid From WC
Get this, I lost my husband back in 2006. At that time and to date still very sad. I get this letter in February of this year that WP overpaid me and wants a wopping 6,000 dollars paid back. They did say, in the letter, that they admit that they overlooked this. I never even paid attention to the little increase in my check every month when he was alive. I had to write them back and give them reasons why I did not pay attention to the amount of my check. I told them I did not pay attention, but I called them one week after he passed to report his death and also taking him off health ins. No waivor now and have to pay it back. They will deduct so much per month and waiting on letter to see how much they will take. I am very upset and probably having back surgery in 2 months. I hope this surgery cost a million dollars. thanks for reading

I'm not sure what wp is - but if they made the mistake and overpaid you , I think getting some legal advice might be a good idea.
things to ask about or check into more - possibly you may not have to pay it back?? or only pay a part/portion of it back?? |

Check your state's w/c laws about the statute of limitations for finding errors. Many states have a 2-3 year statute, after which they can not collect on errors and overpayments. Write a protest immediately. $6,000 may be sufficient to hire an attorney to recover, if you can find one who will do a letter or two to shake 'em up. that is, unless they are within the recovery period. You could also see if there are nay provisions for canceling overpayments upon the death of a claimant.
