I WON MY VACCINE INJURY CASE!!!!!


I heard just before BT went down and it hadn't really sunk in yet, wasn't ready to say anything as it didn't seem "real". I think I believe it now, but will be true believer when the check is in my hands ;)

Understanding that being predisposed and having an extra scalene wrapped around the BP did NOT mean the injury wasn't responsible for the TOS was a little sticky for the judge. My Dr was pretty good about explaining how many people can be genetically predisposed for a condition but not develop it if they exercise and eat right, that a trigger such as obesity or a car wreck is often what sets a previously unknown condition into play.

The other side, even with their high paid expert who tried to say I had TOS all along, could not explain why all my sx started 2 weeks after a tetanus shot - no pain, numbness or tingling, weakness, atrophy, nothing prior to the shot. Their lack of an explanation really helped me!

We are getting things together to make our request for damages in the next week or two. Then we will see what happens...

On the treatment front, I have found a new PM Dr, and I am very happy with him. He has talked with my husband and me about my options, and as I have tried pretty much all the short-term ones without lasting relief, he has recommended we look at long-term options. After a lot of thought and research, I have gone ahead with the psych eval and am scheduled for a physical on the 20th, then on the 29th will undergo surgery for a spinal cord stimulator trial. I will have the trial stimulator in for 3 days to determine how well it works for me, then they will remove it as they are afraid of infection. If it gives me 50% or greater pain relief (in my hands, arms and underarm areas) then they will surgically implant the permanent unit in October.

It's not a MedTronic, it's another company, can't think of the name at the moment, but the battery should last 9-10 years, maybe longer, you just recharge it once a week for 30 minutes, the technology is similar to cell phones. I won't be able to get MRI's so will have to get CT scan with contrast, if needed, and can't go through airport detectors, so will have a ID card and go aside and get wanded. Otherwise I can swim, hot tub, just advised not to scuba too deep or drop out of planes, mountain climb, etc, which I can assure you I'm not planning on doing any time soon!

Am really hoping this is the pain relief method that works for me - I really need something to work for me, and soon. I'm just tired of dragging my hiney around here feeling like week-old roadkill, ya know?

Anyway, it's GOOD news, it's POSITIVE news, and that's how I choose to think both things will turn out. It's been a while since I felt this good about the future, my stress level is much lower and I think I'm almost feeling - I'm pretty sure they call it being - I guess you could say, right now, at this moment I'm .....

I bet you are still in shock!! I would be. What a long and arduous battle this has been for you!!

The spinal cord stimulator sounds similar to hubby's pain pump as far as CT's instead of MRI's, and you have tons of fun at the airport! You can't believe the look on people's faces when you continue to beep even after you show them your card explaining what you have.

I hope and pray that you will FINALLY have relief from your pain, and get a nice, big, huge, gargantuan, settlement!!!!
