Hello!

I am looking into information on Emotional Support Animal's and have somewhat talked to my doctor about this, she is relatively unfamiliar with them. That also goes for the complex I live in.

I would like to know more about the housing aspect of it. Are they allowed to charge you a pet deposit? And if it is a place where pets are o.k., but you have the maximum number of pets already, do they have to accommodate the new addition as well? Or do they make you get rid of one of you other pets (eep!)?

If anyone has answers I would greatly appreciate the help!

I have some questions regarding housing and ESA's.

I would like to know if a landlord of an apartment complex can charge an additional pet deposit fee (when they accept pets already)? If they accept pets, and I am at the capacity they accept, do they have to accept the ESA as well? And on that token, can they force me to get rid of one of my current pets? (EEP!)

I appreciate any information that can be tossed my way!

Yes, indeed they have to accept your ESA if in the USA. Don't refer to your animal as a "pet" ever though, it is no longer a pet, if it ever was. And no, they are not allowed to charge extra for the service/esa. Not that they won't try, as everyone tries and sometimes it is missed by me (for my service dog...once a cab charged extra but that was before I knew the going rate.)

Hotels will also try to charge extra and they aren't allowed to in USA.

From my understanding according to the Fair Housing Act when it comes to Emotional Support Animals, housing cannot charge you a pet deposit. As for having the limit of pets as well as an ESA this part I really cannot say. I know that a Service Animal are exempt to the number and other things that a companion animal isn't but not sure when it comes to ESA.

Remember though that the only two laws that protects you on having a Emotional Support Animal is the DOT and the FHA. The ADA does not recognize emotional support animal therefore you cannot be accompanied with an emotional support animal in place of business.

My suggestion is to contact your local Fair Housing and get the information that you will need. This way you will get the true facts about emotional support animal as these animals are protected under the Fair Housing. I believe that you will need doctor's documentation on the fact that you do need an emotional support animal for your medical condition.

Emotional support animals “provide companionship, relief from loneliness [, and]
depression;” emotional support animals may be allowed in housing with “no pet”
restrictions, but they do not have access to public places.9
