SSI/SSDI Back pay questions
I guess I'll start with a little background. I originally posted here in January. At the time I had gone through 2 appeals and an ALJ hearing, which came back with a Fully Favorable decision but was passed to the now-defunct Decision Review Board.
Well, on the very last day of the 90-day waiting period, the DRB dismissed the favorable decision and remanded the case back to the ALJ for clarification, etc. I had another hearing on July 25th (a Friday) with the same ALJ, and received another Fully Favorable decision in the mail the following Monday! Good news all around, especially since it's been an over-2-year process. OK, so then I talked to my local office about SSI. I know that my SSDI payment will begin in Sept. and that the SSI has been processed and the "back pay" (I never received any interim assistance) should be deposited no later than the end of next week. My question, I guess, is this: What happens now in terms of the SSDI back pay being released and when? My attorney was paid two weeks ago and I know the SSA needed to know about the SSI due to recalculate. I know, too, that I shouldn't worry, but the real problem is that one component of my disability is OCD and I cannot stop obsessing about this. :eek: Can anybody share their experience or shed some light? Please? |

All I know is what happened to me, pretty similar to what happened to you. I got the SSI backpay and medicare within 90 days, but the SSDI took much longer. I got the fully favorable in Sept 07 and finally got the SSDI backpay in june 08. From what I understand the SSI causes the SSDI to be delayed as it goes through the computation process, and they also deduct the amout you got from SSI out of the SSDI backpay. Hopefully yours comes in faster than mine did :) Glad to hear you won. |

you mentioned OCD as part of your medical history. my wife has OCD and cannot go out of the home without assistance due to anxiety. Was the OCD what you filed for the disability under??

My daughter is 10 and has been on ssi, her dad got ssd I got a letter saying she will receive 480 a month for ssd and she gets 674 for ssi. They said they are witholding back pay to see if it has to be reduced cause she had ssi how much will they reduce it does anyone know? Thanks

Windfall offset will apply. SSI will recalculate how much less SSI would have been paid if the benefits from her father had been paid on time. The difference will be paid back to SSI. It is likely that all but about $20 per month will be paid back to SSI. So if there are 12 months of back pay due, it would be about $240. |
my son's SSI
My sons backpay just came in one large sum. We didnt need a lawyer to get him appoved so I dont know how that will work other than the lawyer im sure will get alot of your backpay. Congrat tho.

Janke, You seem very knowledgeable about all of this. :) So, I was wondering if you could help me out on a calculation. I am a retired Fed and know that the WEP will affect me for having been a CSRS employee. But I was only a CSRS employee for a short time; then turning into CSRS OFFSET right around 1986. and avoiding FERS altogether. But before I go further I just wanted to know if you could help with calculation. In any case, I paid into SS for many years. I tried using the WEP calculator on the SSA website but am not so sure it is accurate. Thanks! Oh, and I had read that the GPO and WEP might be eliminated but am certain that will take awhile if ever. :rolleyes: Sorry Ordinary Girl, I didn't mean to hijack your thread. I apologize for that. It is just that Janke has responded with so much good information. :) |
