It's Not Over..............
 

Here's what happened yesterday!!!!! His public defender was SICK, so he wasn't there either. Nobody called me though to tell me. Another wasted trip to court.

The prosecutor told me that now that they have reviewed the info I had given them. They see him in a different way. Not a first time offender.

It's going to TRIAL, unless the next court date Nov. 16th he pleads guilty and takes what is given him. If not a trial date will be set.

The prosecutor said there are no plea's for him. So, people will be supeoned, including myself, the pictures the police took at the scene will be shown, the police that came to the scene will be there, etc - I don't think this is his idea, it's the state's. I think he is now in the poop!!!!!! I really wonder at this point if he will even show up.

I am totally drained and exhausted.

I find it very odd that the court calendar online, has already been updated for the date of the 16th. Usually it isn't updated so fast, especially since yesterday was a Friday.

I think a lot of what has transpired - was him buying more time.

Now that all of his options are exhausted I guess it really doesn't matter.

My court advocate told me that a lot of this was him trying to wear me down and knows it would get to me. Well, it didn't work.

I checked in a few times just to see if you posted, my, no news is good news theory.

Even if it goes to trail, you are not worn down! I read it in you after the court people have told you the options. But, I do think he can just plead guilty, they can't force a trial. That means no plea for a lesser offence, he pleads guilty to all the charges. Then his hope is that sentencing is better or more open ended then if he goes to trail and is found guilty. Sounds like the court will not let him play around anymore, they have him pegged.

ALmost over, closure Nikko, its right around the corner...He will NEVER mess with you again!

I'm new here but I've been following your story and couldn't think what to say. I'm so sorry that this has not been resolved and there's another delay.

Hang in there. This will pass and soon be all over.

I have to find out if it is going to be a trial by jury or a bench trial.

Which I am not sure what a bench trial is.

Oh, this is the pits. I'm sure my DV counsler can shed some light on this. I see her on Tuesday.


I guess I will know next week at the next hearing when they set the date, or what my supeona states.

Nikko I sure hope it's just a bench trial and not a trial by jury. A bench trial is one without a jury, just the two sides and the judge.

I know the waiting will be hard but just try to think positive and that it's almost over and you can get some closure in all this.

So, then the judge has the final say. With all his history, there is no way she could let him get off, right?

His prior's, this last assault, and aggravated criminal damage. All my medical records, my order of protection.

If he gets off or this gets dismissed then I will have NO faith in the justice system.
My head is spinning again with all that has gone on since July and now it's almost Thanksgiving and it's still a burden, I want to get on with my life.

I wonder if he doesn't plead guilty and take the lesser than going to trial would happen next week. Then I wonder how long it will take for it to go to trial. Maybe not much if it is a bench trial.

I mean its all documented, it's all black and white, pictures and all. This had got to end soon and he needs to punished for his actions. As my bumper sticker says 'THERE'S NO EXCUSE FOR DOMESTIC VIOLENCE' and there isn't.

Maybe he is on a bus going somewhere.
