civil judgement and ssdi backpay
 

I am currently waiting for my ALJ hearing, good chance of getting on on the record decision soon though. my question is this, i have a very large civil judgement against me, and i don't know if the person who has a judgement against me will be able to touch my ssdi or my backpay. i currently don't even have a bank account. anyone know?

Federal law prohibits any creditor from taking any of your Social Security, including any amounts of that in your bank account. If you go to court and the only money you get is from SSDI, you will probably be declared judgement proof. Be ure you show up in court and let the judge know your circumstances, otherwqise you will get a default judgement and it will end up being a big mess before you get the judgement reversed.

thank you, that is what i thought, but was worried since i should be getting about 4 years back pay.

Also remember if its child support, or any back taxes, or anything government then they can take it and only up to a percentage like 15%. Other than that nothing can be levied.
