approved for LTD, do I have to keep fighting with wc

Just approved for ltd through my employer. Since I do believe my injury is work related(vs symptoms from MS that wc doc is claiming)I have a wc attorney, am scheduled for a QME re-eval in Jan., and have a deposition set up in Feb.

My experience being in the wc system has been very negative and I'd like to leave it all behind. Can I do that, or do I have to finish what I started?

Thanks, diana

Diana- that's a good question. And its one that your WC atty may not want to answer because it would be lost payment for them if you wanted to bail out.

I don't have the answer for you but I can direct you to California's Info & Assistance page on the DWC webpage http://www.dir.ca.gov/dwc/IandA.html
I have used this service on several occasions when I wasn't able to find answers in the Nolo book California Workers' Comp: how to take charge when you're injured on the job.
I am almost fairly certain your question isn't in the book. And if you can excuse me prodding further into the issue may I ask: How long is your LTD going to cover you? Is it the kind of compensation that can get you through? (Mine's only 2 years and that won't do because its measly. It's getting me by but it offers no money left over to take care of medical treatment- therefore I can't make a good attempt at getting over this RSI madness. See what I mean?)

Keep us updated!

Hi, my LTD is 2 years also, but they said they could extend if it's appropriate, are they telling me the truth? I had alot of my medical expenses covered by my own insurance after wc doc decided it wasn't work related. I think I probably have to continue with the wc claim because I'm sure my insurance co. wants their thousands of dollars back, and std probabaly wants to be reimbursed too if it is declared work related.

One way to find out if LTD is being truthful is to look at your policy which is probably impossible to find on paper, but it could be online if your employer has a webpage for employee benefits. Or it could be on the LTD website too. Or you could just ask them to send you a copy. Life is always better for us WC fighters to have EVERYTHING in writing.

That kinda seems like its right to me (knowing how sh***y the system is). Give Info and Assistance if you want to be assured that is the case.
