question about daughters benifits
 
i have received a fully favorable decision,i havent got my award letter yet,i have a 17-1/2 year old daughter.my daughter was asking me if she would get back benifits,i told her i didnt know yet but if she does it would go to her mother because we are divorced.she thinks it should go to her if she gets any(she is worried it might be used for her mothers gambling habit)is there any rules on this situation ?thank you all

Have you applied for your daughter to get the benefit yet ? I think it was a seperate step from the regular ssdi benefits application.

If your daughter lives with your ex, the check goes to that household and your ex can "blow" it the way she would blow any CS.

Are you already paying CS ? Where your dd is so close to 18, if you don't owe your ex arrears on CS, maybe you could call social security and ask if they would hold your application for dd's benefits for a few months til she turns 18 and she could keep the backpay for herself.

i already pay child support,im payed to date so far,i didnt fill out anything for my daughter to get any benefits. i think i will wait to she decides what she wants me to do about it and explain about waiting till shes 18. i appreciate the reply its very helpful

Unfortunately for you, you do not get to decide when to file the application for the child nor do you get to pick the representative payee. The custodial parent is generally picked to be the payee.

You could jump the gun and file the child's claim and payee application first, and provide evidence that the mother should not be payee. But a parent with custody has priority unless there is some compelling evidence (documents, not words) that indicate she should not be payee. You may not win this.

If the claim is not filed until your child is 18, then the 18 year old is generally paid directly, but by waiting, she may lose some retroactivity if you wait too long.

How old can they get paid
 
I have a daughter turning 18 and I was wondering when I would lose her as far as getting benefits. I was just awarded benefits last week and have not gotten any benefits yet. I thought 18 was it, but I didn't know if it was longer. Thanks
