Default Important Advise on Compensatible Injuries / Conditions

Denise wrote something that I feel is extremely important this is why I've decided to post a new thread on it - Just in case someone missed the question and the advise I gave her.

For those of you who are dealing with some sort of compensatible injury. Work related or other wise...This is important advise that I offer.

If you are seeing any adverse or insurance company, social security or any type of "assigned" doctor one that you are required to see by "the other side" (Not those that are refered by your own physician) please, please, consider all I write.

1.) Always, always have someone with you at these appointments. A brother, sister, cousin, parent, friend, someone who is on your side. REMEMBER: NO ONE can deny you or tell you, that you cant have someone in the room with you. Do not let them intimidate you and tell you no - They can and sometimes will try this...dont be fooled or bullied.

2.) Tape record the Dr's visit - Be sure to advise all parties involved that you are recording the visit - If they do not want you to record it make sure that denial is on tape or that you note it on tape. ** Be sure to check your state laws on recording with or without permission - depending on state this may vary **

3.) Write down all details of that Dr's visit (even if you were able to record it - A tape recorder can not document where the dr touched or checked you) It is important to have it in writing and especially if you are unable to record it. Have each yourself and your assistant (whom ever went to the appointment with you) write a statement in great detail. REMEMBER -They CAN NOT tell you, you are not allowed to have someone IN THE ROOM with YOU.

I write this not as expert legal advise - Always check your state laws and with your attorney. I write this from experience. We had an adverse dr and even a social security dr lie and not give exact details. We were able to catch the adverse Dr. by having another party there at the appointment and also through documentation.

We all like to believe that our insurance company is working for us, or that the adjuster seems so nice that we just could not see them trying to do anything to harm us (financially) but they can and they will if given the opportunity. It is best to be on your guard. This way too if they know that you have someone to back you up they are less likely to mess around with you. It's better to be safe then sorry....
