Per w/c:

"The insurance company paying your workmen's compensation benefits has apparently decided you are able to return to work, They have filed a petition with the Industrial Accident Board to terminate your workmen's compensation benefits. Ultimately, if the case cannot be settled, this will result in a trial before the "Industrial Accident Board, in Which Board will decide whether or not you are capable of working, if they decide that you are not, then the insurance company will be ordered to reinstate your workmen's compensation benefits. If they decide that you are able to work, then your compensation benefits will be terminated."

They will stop paying my w/c benefits. However, my weekly check will not terminate. my case is pending before the Industrial Accident Board of Delaware. So, through the Second Injury Fund, it will pay my w/c benefits during the time my case is pending". If I win, W/C will owe this to the State of Delaware. If I lose, I don't owe anything to Delaware.

What the HECK? How do they know what I am capable of? OH YEAH...I just had my IME from the defense...who diagnosed me 3-5% when OUR doc diagnosed me 50%. HMMMMMMM.......wonder what's up with that?
