At the Appeals level, you have to prove the judge made a legal error in your case. The situation you just named is a HUGE one. The AJL is NOT a doctor.....it's not up to him to say RSD is subjective. He can say your level of pain might be subjective, but the dx was made by 3 doctors....not you.

Did you have a lawyer ?

Was there a voc rehab evaluator there ? He's supposed to say what jobs you can do given your limitations, not the judge. Are your medical records thorough about listing your limitations and functional ability ?

Hi Kathy,

Reading your post I just don't understand why your employer is getting involved with your filing of Federal SSD Beneftis. Do you have a case worker at the Social Security Office in your area, where your claim is being handled? I would question some of the goings on with Allsop, I quess that's the company you previously worked for? As far as I know all companies have to carry "short term disability" either through a private insurer or through there state. Once a detemination is made that the person can no longer work then a claim is processed there the Federal Social Security Administration, SSD. So, I wonder why is a private company getting involved with your claim, it's really a conflict of interest?? Kathy, I'm just looking out for you. I would call my case worker and question it.

Let me try to clearify.. yes, my employer does work thru a private insurer... and mine was processed thu the SSD Administration.. Allsup is a group hired by my previous employer to assist me in applying for SSD (saves the legal help). Once I had hit LTD with my company, they hire this group to guide me in applying for SSD..This in the long run helps put my employer..as once approval for SSD is done..this takes a large financial burden (some) off my previous employer..it's offset/supplemental to LTD..and every company has different private policys... I am blessed as my previous employer, a very large company.. I was there 25 yrs and have fantastic benefits... exp. life time healthcare for myself (and family..children until age 26).. and my husband has survivor benefits...I have lost very little pay while out..on and on..Just wish it didn't have to be this way..I so miss my life there!

Thanks Kathy for clarify I just have never heard of that ever.

I am on Social Security and still continue to work PT as a Business Consultant for a small retail business near my home. I also miss my career but I'll take what I can get and have to keep the dollars down so SS won't deduct from my monthly benefits. Getting out the 2 days does wonders for me, but I get so tired sometimes.

If you don't mind me asking what state do you live in?

I am going to go soak in a warm Epsom salts bath after writing this so I can calm my arm down. I forget to do the extra little things like that, but I just read that on another thread.

Congrats again on your win, you so deserve it. Nobody knows that better than a fellow RSD sufferer.

Hi Elyse, YOU deserve it too. I hope your next try with your attorney goes thru. I know being turned down did make you go into a flare. The McGill Pain Index lists RSD as 42 on a scale of 1-50 You can find this either under McGill Pain Index or RSDSA McGill Pain Index . Print that out and give your your attorney. It's so sad the legal and medical system are lacking in full understand of what we live thru day to day.
Please know we are all pulling for you and getting SSDI. I was turned down my first time, now going to try again. I've had it 15 years-full body or generalized and internal. pretty tough every morning when I wake up. Sometimes it last all day and sometimes I have a little time in the late afternoon or evening of some quality time.
