I'm going to be medically terminated from my job as my Dr. says I cannot return to my WOI also the attorney I been consulting with says that if I hire them I will have to give them 10% of my loss wage checks I just dont know if anything will ever go right with this whole situation. LAWD PLEASE HELP ME Oh by the way their having a teleconferance on Monday to determine if they will approve the cather for the pain management program....CAN SOMEONE PLEASE TELL ME THINGS WILL GET BETTER EVEN THROUGH THE PAIN

Dear Drea,

When you say your attorney wants 10% of you loss wage check, is that a loss wage check from federal disability? If it is I would question that. The cap on attorney fees for a disability claim is currently $6000 and if you don't get it he gets nothing. When I filed it was $5300 and it went directly from the Social Security Office to him and taken off my loss wage check and documented as such on all my papers from social security.

Filing for disability is really a pain. It took me 2 tries, never had to go to court it was settled in lawyers office.

I hope this is a help.

Frown Better, yes--but never the same again. & that's horrible.

I am so, so sorry. You have been thru the straits of hades today, then over the DontGivaSh!t Rapids. Bad news in every direction. It sounds as if everyone was talking about you and "you" were strangely absent from their concern.

I was handed a medical transfer today, after 10 yrs at my job. I don't even have a diagnosis after 15 yrs of going downhill. & I had no clue any transfer was coming. I thought of talking to my lawyer, but...

You're here, so you're able to help yourself. Me too. We've got help here, support. Friends who truly understand. Things will never be the same. But with god's help too we'll be okay. A day at a time. Hey, I nearly died of alcoholism, & now I've been sober since May 9, 1980. Believe me, that's a miracle.

So how about you? Any miracles on your perch of the family tree?

Hi Gabbycakes,
when I say wage/loss I mean workers comp which I have been receiving since I been off work this time. She says that I will need to consider applying for SSDI once I have recevied a final judgement as far if I can do any other work besides my Job of injury. I hope this makes sense

I so appreciate the words of encouragement and I do have miracles I have made it through a lot of life struggles it just seems in the last yrs it has been one thing after another I will have to gather the will to have the faith to make it through this to nd congrats on your sobriety thats awesome

I think it's very odd that your attorney would want 10% of your TTD checks. I am currently on work comp and the ONLY time my attorney has ever taken anything from my TTD checks is when they were disputed (ie...they stopped sending them and my lawyer had to fight to get them to send them again). And then he only took out of the disputed amount and the rest come to me with nothing taken out. I know every state has different rules when it comes to attorney's fees...but yout TTD is your TTD and you would be entitled to it whether you have an attorney or not so why would they take out of it unless it's a disputed amount?

But I hear ya...dealing with RSD is bad enough but then to have to deal with work comp on top of it is just awful. Things will get better...they always can get better...but like someone else said they will never be the way they were. I hope things get better for you soon and that you get what you need to help you. Good luck!

I filed for SS Disability & was denied. I appealed twice, on my
Own, and was denied both times. I hired an attorney, with the
$6000 limit (on contingency) and was granted SS Disability.
SAME EXACT SITUATION, SAME EXACT DOCTORS' RECORDS ...
But the attorney got it done.

IF you win, the money is taken directly out of the
Retro wages before you see any money. It is a
Racket, but one our legal system thrives on.

Get a GOOD attorney. Don't let the attorney
Mess things up for you.
