Default Retrial of Doctor wrongly convicted of drug traficking

Hi.. interesting article on the possible apeal/retrial of Dr Eliot Herwitz.. He recieved 25 years for so called traficking in drugs to chronic pain sufferers and because one or more of his patients sold as well as took his perscriptions and because of the doses perscribed.

This is yesterdays article in the New York Times.
http://www.nytimes.com/2007/03/27/sc...ml?ref=science

In the origional trial the doctors good intentions were not taken into account nor the new literature on dossages NESSARY to controll chronic pain.

I think he was railroaded, as a statement.. had alot of doctors and patients alike very concerned.. Still do, mabie this will help as it can/will set a precedent if he gets off.

Here is a quote from yesterdays article:
"Some of the country’s foremost researchers in pain treatment and addiction supported his appeal for a retrial, which was ordered because the jury in the first case was improperly instructed to ignore whether Dr. Hurwitz had acted in “good faith.” These scientists say they are upset by how their research has been distorted by prosecutors in this case, and suppressed by the Drug Enforcement Administration in its campaign against the misuse of OxyContin and other opioid painkillers."

I will go find the origional story in a bit, my memorys foggy on the details of the origional trial..

Anyway thems just my scattered thoughts.
