Diprivin/Propofol which is the anaesthetic agent used to put you off to sleep almost always causes extreme pain when going the vein. It is unfortunately listed as a side effect and most decent anaesthetists will warn you before they inject it. Some anaesthetists add some local into the Diprivin to make it less painful.
Every time I have it I feel as though I am being burnt by the substance but it actually causes no harm at all to the vein.
Whether you could contend that you were not forewarned about the pain and attempts were not made to ease the pain I am not sure but I am not sure they will agree that your RSD started with this injection as severe pain it is part and parcel of the drug.

Having said that I do wish you every luck in the world but I do know, as cake says, they are very, very hard to sue and sometimes the cost to you in terms of health and stress may not make the payout (if one is allocated) worth the effort.

Hi Tayla, you took the words that I was going to type here. When I was being put "under", I had the same, stinging, pain so bad, that you feel like ripping the entire I.V. out! I couldn't wait to be put under, as this pain was so horrid and hurt so bad!! Just a note here, the bigger the city, the better the lawyer.:Good-Post:

Desi,
I am so happy to hear that you were able to find a good attorney helping your husband to win. Did your husband suffered RSD caused by a malpractice? What were the secrets of winning and what kind of award did you folks receive if you don't mind to share?

I hope you have found someone to take up your cause...
I literally went to over 12 attorneys and was rejected time after time, I was two weeks before the statue was up and I took the advise of a trusted friend who told me to find a new,young, zelous and aggresive attorney who would be willing to possibly make a name for themselves. I literally found someone online who took up my cause, believed in the case and the largest malpractice firm in the state is now on board as lead counsel. I refused to give up until the last day I could try.
I had heard everything from, you don't have a case, to find your own expert witness, to a bad outcome is not always malpractice. Each lawyer had their own excuse not to take on the case.
I am scheduled for trial in about a month and hoping for the best.
Someone spoke about deep pockets, essentially it seems that's what it boils down to and to have the attorney find an expert from another state.I drove 3 states to meet with that person and it was worth every mile.:o
