Definately, appeal. When you applied did you submit medical evidence with your application? Also non-medical evidence is important, like your absentee rate. Letters from doctors? If not, you might want to submit them with your appeal. The first appeal is called reconsideration Unfortunately, 89% of claims are denied at his level.
I would consider filing your first appeal without a lawyer then if you get denied hire a lawyer. You can call Social Security get your records and the reason you were denied (typically you can do current, past or other work). Then correct the application's faults.
Also, the Adult Function Report is an important supplemental document to submit with your appeal if you didn't submit it with your application. Write as much detail as you can. Everything is important when filing your claim.
There is a copy of the Adult Functioin Report on my ** Also, your doctor should fill out the Physical Residual Function Report, also available on the website.
Good luck. Keep us informed as to what happens.

You have 60 days. Don't wait get it done as soon as possible. Go to the SS disability site and find out exactly what forms you need. Make sure you give them the names of all your doctors. No matter how insignificant it may seem. There are 5 stages SSI uses to make their decision. If you miss one they sometimes deny you right there. Did they tell you why you were turned down? Sometimes you have to qualify through a different agency.

On my denial letter it says. We realize you cannot do any of your past work but you can do other work.

I read a post that you put down that you use a cane. Well I also used a cane and crutches for a very bad knee. The day before I went to see the ALJ my lawyer(Allsup) called me and told me to use crutches and tell them I currently use them everyday. If you use a cane there are jobs in the economy you can do. You can carry items with a cane whereas if yo are on crutches you can't carry things. If you do not have an attorney I would get 1. Also make sure all of your doctors are behind you 100%.

That seems a little vague. Are you qualified to do other work? The ball is in your court you have to prove you can't do any work. At this point you may want to get any attorney. I have a feeling they want more medical evidence.

I have attained Allsup to represent me for my appeal. I just fell and tore my tendons in the foot that I am appling because of, so now I have a pretty pink cast. I'm also getting ready to schedule more surgery on my SCS in about three weeks when the cast comes off. Can this new evidence be used for the appeal?

It seems your doing all you can. Make sure your attorney requests your records from SS and ask for a copy. Make sure all your doctors are in there with an evaluation. Make sure everything is right, because they do get things mixed up. Good luck, to me it sounds like you're going in the right direction , so now it's just a matter of time. I think in 4 to 6 weeks you should get some good news. Be careful, and take care of yourself.

I suggest you file your reconsideration yourself. Contact SSA immediately and get a copy of your file. It will ssay why you were denied benefits. Submit as much medical evidence and non-medical evidence as you can with your appeal. Write summaries of the medical evidence, detail descriptions of your limitations and get doctor's letters.
Most claims are denied at reconsideration and lawyers do not make an effort to get you approved at the first appeal.
