Default Maybe winning a lawsuit

If I do win can SSDI stop my disability checks? I did not know if it was "substantial gainful activity". Thanks all! Have a good day.

It's not substantial gainful activity, but if the lawsuit is connected to your disablility it could still decrease your SSDI check the same way my WC payments decreased my SSDI

I found this case it's an old case, so you might want to go ahead and call. I'll see if I can find a more recent case. I read sections 1602 and 1612, this explains the laws.

That case is about SSI, not SSDI.

Tadpol........You should be good. Only WC and public disablity payments will affect the SSDI amount

Sorry for being a pain but just another question. Should I report the money from the lawsuit to SSDI?
If say I was on SSDI for Myositis and I broke a bone but not the reason that I am on SSDI it was just a lot of pain for 2 mnths and it happened after I applied for SSDI, do you think I am ok? Sorry for being a pain but I am worried and confused.

It's totally not related. If you were getting SSI, which is based on financial need, then yes, you would have to tell them. A lawsuit for an unrelated thing is the same as your spouse getting a raise, or winning the lottery, or getting an inheritence from your parents.......not any of SSDI's business.

SSDI only cares if you are working or if you collect public disability benefits.

And you're not a pain ! I didn't know much about SSDI 5 years ago when I was applying. Had a lot of time to read up on it during the 3 years it took to get approved. There aren't any stupid questions, always better to ask than to worry !

You have been given information from strangers on an internet site. If you are only on SSDI and not SSI, winning a slip and fall lawsuit will not affect SSDE, it will affect SSI.

But then again, I am also a stranger on the the internet who cannot be held accountable by anyone. and don't know any more than what you have provided. If you want an answer from an official source, you need to contact SSA. Perhaps that would help relieve your worry and confusion.
