Default State Disability

I was put on state disabilty for 2 months about with the diagnosiss of tendonitis. Now the doctors - across the board do not want to put me back on it - refusal saying there is only negative work up to now with my condition - They say there is no tendonitis and other things found in the Xray or the MRI I just did. I had a diagnosis of tendonitis - but now the doctors are calling it Repetative Stress injury - and I know there is no acceptance of this in SSDI - its an umbrella term. I have chronic pain with most of what I do with my hand. I can pick up around hte house lightly and my hand starts to ache more after 2 hrs. I typically rest and not push it - now I am thinking maybe I should flare it up? It seems only rest helps and stopping before the pain starts up.

I was wondering if any one else has experienced their doctors not wanting to give them temp disability with the state - not ssdi. The doctor is putting me on work restriction because I pushed the issue - I got laid off when I was hurt again and have been out of work for a year. (I think this is why they wont fill it out cuz I have no job to go back to among other reasons). He wants to get my pain under control before he allows me to go back to work. I am being told by unemployment that I cant take it cuz I cant go back to my normal work. I get told by state disability that I should be on them since I am injured from work. Does or has anyone gone crazy with all these rules and bouncing you back and forth? Is this normal for doctors to be like this? Tell you you cant work but not give you the state temp disability? I know in the end my SSDI is weakened by their actions. I didnt expect to get it really - just was doign as I as told since I was told I will be crippled and not be able to keep a job due to my condition. Just doing as I was told by a lawyer who seemed to have my better interest.

They are also referring me to a chronic pain clinic under Kaiser. Does anyone know about this? I will ask under the pain area as well.

I guess I just want to know if this entire game is normal. Its absolutely driving me nutty. They sure dont take into account the patients well being. They say the money is not their responsibility but it sure is when they withhold it. I am just a little bent over this. Just makes no sense and now for them to down grade my condition just really ****** me off.

I'm a bit confused.
Was the injury work related?
Did you file a work comp claim?

Is that why the drs have down graded the diagnosis?

Or are these your own drs?

Oh , I took a look at your other posts, I thought your name sounded familiar.. I replied to you one some of the earlier threads.

I guess my next question is do you have a good work comp atty?
A good one will hopefully point you in the right direction in the best steps to take now.
{ do internet searches to find good ones & interview a few before signing }

I think you need some professional legal help to get back on track, if it is a work injury you really should go forward with that system.

If it is the WC drs /or employer telling you to go on state disability - they may be hoping you won't follow thru on the wc injury claim.

you have tendonitis,,, you have been off work for a year?,, youhand ard arm hurt,, you got hurt at work?,, what have you been doing for that year other then going from doctor to doctor,, why havent you contacted a Lawyer for workmens comp if you git hurt at work,, I seem to be missing some of the issues,, you need some serious advice from a lawyer,,,

I went thru workers comp. They wouldnt deal or give me treatment so I settled. I know.. I maybe shouldnt have.. but I did. I was told I wont get anything else. Lawyer told me to file for SSDI and told me we were here since I reached perm/stationary. Yes it was work related.

I have been going to my own doctors for treatment - to try to get it resolved. Now, they are saying they cant do anything since no xray shows that I have something that is diagnosable. I have pain - and it gets worse the more I use my hand. Since I am not employed I am lucky to be able to stop what I am doing to rest it - and my mom will finish or help being that I had to move back home.

So.... I may have been screwed by my lawyer or not - its a closed case and settled. He told me that I should try to get state disability for as long as possible awhile getting treatment with my own medical care. The workers comp QME doctor told me that what will happen is that I will have to close my case to get care - get better, then take a job and get hurt again. He said at that point they will fight about whos liability it is. He said the system in the state of California is a mess and was destroyed when our current governor took over and messed up the system.

I have already gathered that alot of people dont close their cases. Wish I would have found this site before I got to that point. They were denying me anything, but approving drugs - so I just took the $, what little it was, and then am trying to get care outside of it. I have to say so far Kaiser has been good - but it seems they dont like to give disability - even to those they feel shouldnt work currently -

It makes no sense to me. No laywer will take my case since its closed. THey will only take on my case for SSDI - but only when I am denied and ready to go to the judge hearing.
