Hugs to all of you- Get THIS on his denial it states THEY (SS) know he can't do his previous work but there is something less demanding-HUH- I wonder if they could find him a job where he can have his leg propped up above his heart and then a BED to lay down in as he can't sit without laying down. Boy are they STUPID or What???
Thank the good lord for people on here I am disabled myself but I don't know where we would be if it weren't for my little check. In our state he doesn't qualify for Medicade I have asked !! And we do get Food Stamps. We don't have a choice-He can't work simple as that!!! I have found a clinic that goes on a sliding scale I got him appt for March 18th. for his Back,Hand and Hip. Oh Boy the lawyer Monday is going to laugh they said in so many words he is disabled. We will keep fighting!!! Thank you all for your kind words and all the help we sure need all the help we can get. no they only accept children here. Don't ask me why?? No we do not have assets I have to beg people to help with my electric and rent He probaly will get medicaid when he gets medicare.

Then it is up to SSA (or the voc rehab specialist at an ALJ hearing) to find work that he can do with that restriction.....which is no job that I know of. If his records don't address that....or simply say he mist elevate his leg periodically, SSA will believe that he can just use a footstool. |
His denial said they realize he can't do any of his previous work but could find something less demanding.
I will get a copy of his medical records-Does anyone know if I can get them from SS?? Right now he goes to the health dept and sees one doctor and Yes she is behind us 100% Even their doctor told us to get a lawyer if we get denied. He is being trated for his depression he is on Prozac, He takes 4 blood pressure meds. And he takes 2 types of warafin-10mg and 5 mg- for the rest of his life. His nephew filed for ssdi for the same thing only he has factor 5 and I am thinking about having him tested for that. As it runs in familys- They both got hurt at work . Sorry about the hassles you and your husband are dealing with. I was denied last fall, but quickly obtained an attorney. SSI's reasons for denial was CRAZY. They did not send me to a medical doctor, but just to a psychiatrist. The letter stated that I am definitely physically impaired and the only job I could really do was one that was stress-free. Um, excuse me but name one job that is stress-free...
All this was prior to the implant of my hateful spinal cord stimulator. Since then, things have gotten worse (as if they could get worse...). SSI had stated that a person needs to be physically unable to work for one year - I have been off work with a medical slip from a doctor (orthopedic knee surgeon, orthopedic foot surgeon) for well over that. They never did obtain the orthopedic foot surgeon's records, so my attorney filed for a case review and a quicker hearing. He is in the process of gathering my current medical records as well, and is extremely positive. He keeps telling me that he was shocked I was denied in the first place, but he also tells me that this is the "norm". He likes to point out the fact that since I had worked for so long that sometimes the government doesn't like to lose taxpayers. I hate not working, I hate being in pain, worrying about finances. And the government thinks I can work a job that is stress-free... If that statement wasn't so funny, I would be super angry. Good luck to you and your husband. If you don't mind me asking, what state are you in? Have you looked (or asked your doctor) for any programs out there through the pharmacies or drug companies that will assist with prescription costs? Is your husband a veteran? I know that while my father was fighting with SSI, he was able to get benefits from the V.A. It was a small amount of money a month along with medical (provided he went to a V.A. hospital/doctor), but it was a lot easier to get this started and provided him and my mother with the means to stay afloat until SSI kicked in. |
