I have another question ... I know that there is a 5 month saying period for your back pay and benefits, my date was changed from 2/09 to 4/10. So, do I get all of the back pay from 5/10? Or will it start from 10/10 and on? Then the lawyer fee, is that taken of of my back pay from 10/10 or from the date of 5/10? Is the fee really set by SSD? I read somewhere that it was 3000. And some place else that it was 6000. I'M SO CONFUSED .....

I replied on your other post but I will repeat and answer the question. If your onset date is 5/10 then backpay will start on 10/10 and your lawyer's fee are as follows: 25% or $6,000/maximum. They can only collect starting 10/10. The fee was $5,300/max if the contract was signed before June 21, 2009, but after it is $6,000/max. So if your backpay is only $10,000 then they can collect $2,500, 25%, but if your backpay is $50,000 then the most your lawyer can collect is $6,000, not $12,500.
Good luck!! |
