The problem I have ran into is my wife and I divorced at the time I was going to get my SSDI and the checks for the kids went to her. She would not pay the ltd back so I owe alot of money I don't have. Also I owe more due to the person at the ltd had told me that my exwife had paid the money back and I owe x amount of money. I paid them the x amount said and thought all was good. A year later they notice may exwife did not pay and they had paid to much and wanted back pay for that also. I don't have the money to pay them back. What can they do to me? I don't thing they can garnish my SSDI check, but I don't know.
Please let me know what they can do. I am going though all this at the time.

Default Paying back your ltd

I am also currently awaiting my ssdi back pay, and of course my ltd expects all of it as back pay, however, I have been researching and actually spoke with an attorney who handles cases with ltd companys and ERISA. You do not have to pay the ltd back from your ssdi backpay award. Now of course it depends on how much your ltd company will continue to pay you on a monthly basis as to weather it is worth it to you because they will automatically cut your benefits until the repayment is made. In my case they will only continue to pay me 118.00 per month, However when my back pay is paid to them in full then they have to reinstate my monthly benefits if it is still within the timeframe that I would have continued to receive benefits from them which in my case is untiil the year 2032. This is all very confusing and also a little scarry, I am still not sure what I will do. Although the lawyer gave me all the info I needed, they cannot sue you, they may turn you over to a collection dept. Anyway if you would like the email he sent to me just let me know and I will be glad to forward it then you can decide which option is best for you. Hope this info helps a little
