Had a long talk with sister in law, Its been 3 years with her fibromyalgia(spelling?)....I suggested maybe she should try filing for SSDI?
With so little known can one get it? She has gone to all kinds of DRs with no relief. She is 56 now and feels like the money situation is her fault as she hasnt worked in 3 years. Anyone here get SSDI from fibromyalgia? How long did it take? Special Dr. that might help? Never been a big fan of hers, but im feeling bad for her in such pain for doing the simplest things! |

i dont know about fibromyalgia, though i do know people who are on ssdi from it. If she is going to apply she should apply as soon as possible. you hjave to have work credits for 5 of the last 10 years to qualify ( 20 out of the last 40 quarters). also the longer she has zero income before she files the lower her amount received will be. remember when filling out the forms, it is not just the illness you have that qualifies you but more importantly how the symptoms of that illness and treatments for that illness affect your ability to work. Examples...cant walk very far, cant stand long, cant sit long, difficulty or not able to kneel, reach,climb, difficulty concentrating due to pain or medications etc.

She will need records from her drs, so getting those records an making sure they are correct as to facts of her condition..
Often things are left out or even typos, errors..those need to be corrected.. Much depends on if she has been getting ongoing medical care for the condition/symptoms..If not, it's hard to prove... The sticky threads are the best place look for tips & help, suggestions.. Some may be older posts, but they can give you ideas to web search and check for updated info..

She has worked over 30 years, she is now 56 so she has her SS credits...I didnt think being out or the workforce effected SS $ so much?
She has been to numerous Dr.s. and should have all kinds of documentation. She said she didnt want to sign up because she believes she can get better. I told her that is not a problem, get better get back to work...She has lots of misconceptions about the whole system! I got mine first try in 4 1/2 months, but mine is completely different and happened 14 years ago....I was 44 at the time of my accident. |

Now is the time to file. She has already given up a potential of two years of payment by waiting three years. SSA can pay 12 months back from date of filing, but she needs to file now. The process can be long with lots of time when nothing seems to be happening. If she is denied initially (30% approval on initial claims) and goes through the appeal process, it can easily take a year or more to just get to have a hearing in front of an ALJ. If she waits until July, she will have lost one more potential month of payment. She can work on understanding the program while she is waiting for a decision, but it is time to file. Now. |

Since she waited 3 yrs, if it were me I would get an SSDI attorney. Make sure it's an atty that "specializes" in SSDI cases.
Their fee is "capped." The capped amt depends on the state your sister resides in I believe.

the capped amount is federal....ssdi is a federal program . it is the same all over the united states and territories

Update, yes she did file and got SSDI in about 6 months first try..
She is now going to Mayo Clinic in Minnesota... I hope she finds some answers. |
