Confused In a mess here

Last February, I hired a lawyer to get disability. I have been denied 3 times so now it goes to court . I am in Ohio this is how it works I guess. I didnt get to see my lawyer so I could apply for the hearing. They have given me 15 days here to send in a letter I thought I had sent in after I saw my lawyer. They are saying they didnt get it. And want a reason why they didnt get it in the time they said I had. And now I cant for the life of me remember why I was late . What do I say? I want the hearing yet. But I dont want to make up some white lie if you know what I mean? What should I do now?

Thanks ahead of time for any suggestions or help. Sorry if I am vague here. Tired and sorta worried .

Beth

Well it looks as though it may be up to me. I called the lawyer and he is out of the office this week. I hate this. I am not good at wording things. I left a message for him to call me back ASAP. It would be nice if he could take care of this lol.

I also called some of my doctors as my lawyer told me I need to get evals from them. But they are telling me that they need a written request from the lawyer or SSA for this stuff. I cant just request it myself.

Luckily I was on a search this morning for the paper the lawyer gave me of a list of things I need to do. And he had on there the reasons why this didnt get filed in time. So I dont need to tell a white lie. Whew! My memory is shot.. and I couldnt remember the reasons for the life of me.

Thanks Joe for the reply.

If they turn down your appeal for a hearing because you did not get it in in time, i would immediately file a new case and start over. There have been some good discussions recently on brain talk social security board about how to fill out the initial applications and how it is more important that you state how a disease or medicine prevents you from working than in just proving that you have that particular disease or condition.

Thanks for the heads up on this Joe!! And thanks for the link too! I am sure all this information will come in handy. I have a feeling that with this last letter that it means they want to get the ball rolling on this soon. AT least that is what I hope it means.

You may want to check out the Social Security Disability Coalition A very good resourse website for people dealing with Social Security Disablity issue and there are a lot of issues with these people.

I had to fight with these people for 3.5 years and won my case before an ALJ IN May 07.

Always I repeat always keep a hard copy of any document you give these people and if it is time and date stamped at the Social Security office that better and remember you will have to produce the same imformation 3 times
or more.

2. Start a file for all your Social Security documents, I have 4 boxes of documents and the summery report at the Social Security file is 6 inches thick and 1000's of pages long.

Do your home work the above website is a good place to start.

Take care. Jeff
