Default SSD and new W/C claim

Anyone have a clue if I am on SSDI and worked part time, but would now be awarded W/C a menial amount if it is reduceing my Soc Sec monies?

When I worked I made $600 a month. My UC that was not disputed is $70 a week.

I just can not heal from the second w/c injury enough to go back and find something part time. I had been in a hostile work environment and for three months it escalated to the point they wanted to make it so miserable I would quit.

I did not do anything wrong and just broke from having a anxiety/panic disorder that they played on.
I thought after a few months away and counseling I would be OK, I am not. I need safe people and advocates to perform task, medications, and high cost for counseling and medications.

I feel that the employer destroyed me emotionally, and I need help to get back to a quality of life again. The employer put me at physical risk on more then two occasions by safety breaches they created, broke rules and did not provide memoes of trainings, meetings, or acknowledge me.

HR was the person working pt time with me and she wanted my position for her bf. IT was horriffic. I watched this done to two other employess and as soon as HR found out I was on disability she made my work day beyound miserable, it was unbearable.

I made good money for part time, half days 3-4 days a week.
I just am courious as I am applying for medical W/C to pay bills, what would happen if I am not able to work and no longer eligiable to receive UC, and am put on W/C?

I really need the medical part to regain my passion, motavation, secure, and be strong. I use to be in law enforcement...these two women have me that I can not even leave the house for long or without someone going with me or meeting me.
It reminds me when I was in an abusive marriage how I felt and needed to rebuild.

Oh , gosh..
I don't really know about the SSD & wc complications or how they offset each other..

What about a hostile workplace action?
I suppose you'd have to prove it somehow and that might add to stress & anxiety.

I don't know if it might be easier or better to just see if you can qualify for full disability/ soc sec, due to the accumulated effects of stress, anxiety, TOS and other health issues.

They must have really wore you down the stinkers

you're still tops in my book.
wish i had more knowledge on it for you.

Well, this morning has not been good for me physically and emotionally, so I may vent through your misery too, if I may.

I believe there's a special place in HELL for SOME adjusters, HRs, Dr.s & lawyers who do hurt and injured people like it sounds like they treated you and I have experienced. Really, I believe that.

It's a shattering thing to discover ugly in other people who have the authority to make the situation easier, not harder on an already pressed to the max situation. I thoroughly didn't appreciate paying for that kind of treatment and I do want to get beyond it.

So often we do get knocked down, but I'm getting back up (slowly) to fight back... and fight I will.

I don't get to do a lot directly with SSD but you can find out a lot online or by calling or visiting the SSA.

I have heard, that in July, Medicare recipients who are involved in litigation for future medicals will have to set aside a portion, a good portion, for future medical benefits. This poses a problem with settlements and benefits. Don't know all the details but the change is coming July 2009, along with other changes related to SSD & Medicare benefits. I'm sure they are going to violate the sick and injured too. :

Yes that is what I learned to. That future settlement of workers comp, the soc sec want a trust or something in place to cover the medical poprtion so the medicare won't have to.

I had the papers in my hand to file a complaint as these people were my support last two years to get through the most difficult thing in my life. I felt in a safe place and instead inturned into he!!. But I am in an Estate, Mal Med Practice suit.

I had to take Ativan to get to work and still had chest pains, not because I was in rooms with level 4 sex offenders, but because I had no idea what new trick they had to undermine me.Only after HR questioned me about being on SSDI did the whole environment change. Same gal, HR did it to a nursing mother and she quit.

It devestated me emotionally. A double heart break.
I am at least going to file to the director for w/c and see what happens under creating a work environment to constructivly subject me to emotional distress knowing I had a disability. Subjected to intolerable mental stress and no way to file a grievance, as the person constructing the situations was HR!She was a clone to the supervisor and supervisor jumped the hoops HR set up.

Dang I keep forgetting the phrase...I want to use it in the letter to the director requesting to file a claim...
My brain is so overloaded. I have to remember that phrase over the weekend.

I regret hearing of the problem's you've experienced....The world is a different place for some of us, who were raised to be friendly and honest...Treat other's how one wishes to be treated....Do Jerks want to be treated as such...Now where would that get us....The world has become quite mean...I understand your words all to well....I'm trying to get SSD and have been on WC for over 4 years....And wish like mad the Poconos' weren't so far away from Upper Darby....I'm not from here and feel quite alien...My issue is whole body CRPS....Pain makes one froth at the mouth....Darn near needing an exorcist, I'd say....No one understands pain and pain more than Physicians know what to do with....Talk about creating emotional issues....Yuppers...I'm on board with how you feel....If you wanna talk some time...I have free long distance and have two working ears....I hope things have smoothed out for you though....I truly do....Hugs P.S. I'd speak to a few Attorney's if I were you....I believe you're HR person is breaking quite a few laws...It's illegal to discriminate against the disabled..in more than 1 way....She's also creating a situation where she could be sued in a civil case as well....:?') I'm sorry that you are dealing with this, Di. You have been through sooooo much already.

SSDI has a maximum family benefit that you can get based on all of your income. When I was collecting WC with my SSDI, my SSDI benefit (and my kid's benefits) was lower because the total income took me over whatever my cap was (they never told me a figure). My ssdi bumped up when WC payments ended. My kid's benefits jumped up huge after the change (from $66 each to $450 each)

Just report it to them. If you aren't receiving children's benefits, your new total might not be over your 'cap' income.

If you get a lump settlement for medical that documentation should be clear that it is for medical, NOT a lump sum salary payout. Are you working with a WC lawyer ?
