Has anyone who received ssd back pay who had ltd from work . did your company make you pay it back. and how long did you take to pay it back.

I am right now waiting for my back pay so I can pay back my LTD. They will take it from that, but I am sure they would not let me take any longer than that. Bummer it is most of my back pay, but at least I will be getting the SSDI monthly now.

I am also currently awaiting my ssdi back pay, and of course my ltd expects all of it as back pay, however, I have been researching and actually spoke with an attorney who handles cases with ltd companys and ERISA. You do not have to pay the ltd back from your ssdi backpay award. Now of course it depends on how much your ltd company will continue to pay you on a monthly basis as to weather it is worth it to you because they will automatically cut your benefits until the repayment is made. In my case they will only continue to pay me 118.00 per month, However when my back pay is paid to them in full then they have to reinstate my monthly benefits if it is still within the timeframe that I would have continued to receive benefits from them which in my case is untiil the year 2032. This is all very confusing and also a little scarry, I am still not sure what I will do. Although the lawyer gave me all the info I needed, they cannot sue you, they may turn you over to a collection dept. Anyway if you would like the email he sent to me just let me know and I will be glad to forward it then you can decide which option is best for you. Hope this info helps a little

You need to apply for benefits on your own. The LTD company is not helping you with a lawyer, who is really working for you, put the company. This looks to me like a conflict of interest.
You should hire a lawyer of your own when you need one. If you have not signed an agreement to turnover your back money do not. Let's say your LTD company pays you $1300 dollars a month. Your SSDI amount is $1000 per month, You have them keep the $300 dollars a month. Let's say your back money is $10,000 you repay them in about three years. If you have to pay the LTD company your back money the company will try to cancel your policy, and terminate your benefits. You may want to find this book at your local library. When SS is awarded they issue a check that back-pays you for all the benefits from your qualifying date to the present, and you can pay your LTD back from that. Mine was like about $29,000 and I basically just turned around and paid back my LTD plan from that.

I ended up having to quit my job, then applied for SSDI and when received i never told the LTD carrier. I figured I had paid a few bucks per pay for the insurance and if they wanted their $$ they could come find me. So far so good 6 years later.....
Just put the $$ away and wait for them to contact you for payment. ![]() ![]() ![]() |
